According to Article 266 of China's Criminal Law, whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years. If the amount is especially huge, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
More than 50,000 yuan is already a "huge amount". Under normal circumstances, it is very rare to be convicted of "fraud" because of overdue credit cards. As long as the credit card is used normally, if there is really no repayment ability, it will not be convicted of "fraud".
If the credit card is overdue, the bank will definitely go to court to sue, so don't care. You must go, honestly admit it, and then actively cooperate with the court. If in this process, the court finds that the person subjected to execution hides, transfers or intentionally destroys the property, or transfers the property for free, or sells the property at an unreasonably low price. This will be ruled as "refusal to execute"
According to Article 3 13 of the Criminal Law, those who refuse to execute the judgment or ruling of the people's court, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined.
