What's the impact of leaving a criminal record?

The effects of having a criminal record are: it will affect yourself and your children to participate in civil service examinations, conscription and other political trials. A person with a criminal record may be a recidivist when he commits another crime, even if he is not a recidivist. Those who violate the criminal law and are investigated for criminal responsibility, if they are public officials, will be expelled from public office, and party member will be expelled from the Party. People who have not held public office cannot apply for public office. At the same time, people who are investigated for criminal responsibility cannot engage in professions such as lawyers and notaries. Having a criminal record not only has a negative impact on yourself, but also affects children's participation in civil service examinations, conscription, political trials in banks, state-owned enterprises, institutions, military schools and police schools. Article 13 of the Judges Law of People's Republic of China (PRC) shall not serve as a judge:

(1) Having received criminal punishment for committing a crime;

(2) Being expelled from public office;

(3) Lawyers and notaries have their practice certificates revoked or their names removed by the Arbitration Commission;

(4) Other circumstances prescribed by law.

Article 26 of the Civil Service Law of People's Republic of China (PRC), the following persons shall not be employed as civil servants:

(1) Having received criminal punishment for committing a crime;

(two) was expelled from China * * * party;

(3) Being expelled from public office;

(4) Being listed as the object of joint punishment for dishonesty according to law;

(five) there are other circumstances in which the law stipulates that it is not allowed to be employed as a civil servant.

Legal basis of criminal record

Article 482 of the Criminal Procedure Law of the People's Procuratorate: If a person was under the age of 18 at the time of committing a crime and was sentenced to fixed-term imprisonment of not more than five years, the people's procuratorate shall seal up the criminal record after receiving the effective judgment or ruling of the people's court. If the people's court of second instance makes an effective judgment or ruling, the people's procuratorate at the same level shall notify the people's procuratorate at a lower level to seal up the relevant criminal records in accordance with the provisions of the preceding paragraph. If the criminal record is sealed, it shall not be provided to any unit or individual, except for the need of judicial organs to handle cases or the relevant units to make inquiries in accordance with state regulations. Units that inquire according to law shall keep the sealed criminal records confidential.
