Legal Issues of Portrait Rights

According to Chapter 4 "Portrait Rights" of Part IV "Personal Rights" of the Civil Code: "Natural persons have the right to make, use, disclose or permit others to use their own portraits in accordance with the law."

2. Without the consent of the portrait right holder, the portrait right holder shall not use or disclose the portrait of the portrait right holder in the form of publication, reproduction, distribution, rental, exhibition, etc.

4. No organization or individual may use information technology to defame, disfigure, falsify or infringe on the portrait rights of others.

5. If the parties to a portrait licensing contract have a dispute over the terms of use of the portrait, they shall provide an explanation that is favorable to the owner of the portrait.

6. The protection of natural persons’ voices shall also refer to the relevant provisions on the protection of portrait rights.
