Can the detention center let people go home directly after the criminal case is suspended? Or wait for the verdict to take effect?

After the probation is announced, the non-serving prisoner shall be released immediately. If a criminal is in custody, the people's court of first instance shall first make a decision to change the compulsory measures to residential surveillance or bail pending trial, and immediately notify the public security organ.

Legal basis:

The Supreme People's Court's Interpretation on Several Issues Concerning the Implementation of the Criminal Procedure Law of People's Republic of China (PRC).

Article 355 A criminal sentenced by the people's court of first instance to criminal detention or fixed-term imprisonment with suspended sentence shall not be executed immediately before the judgment has become legally effective. If a suspended criminal is in custody, the people's court of first instance shall first make a decision to change the compulsory measures to residential surveillance or bail pending trial, and immediately notify the public security organ.

Interpretation: After the court announces the probation, it must first make a decision to change the compulsory measures into residential surveillance or bail pending trial, and immediately notify the public security organ. After receiving the judgment of the court, the public security organ shall unconditionally go through the release procedures and issue a release certificate.

At the latest before 24: 00 on the same day, a suspended criminal may leave the detention place and go home.
