If the parties have corresponding evidence, they can bring a lawsuit to the court.
The crime of bending the law for selfish ends refers to bending the law, a judicial officer, who makes people who know that he is innocent prosecuted, intentionally shields people who know that he is guilty from prosecution, or deliberately violates facts and laws in criminal trials.
Suspected of one of the following circumstances, it shall be placed on file:
1. Forging, concealing, destroying evidence or other means to conceal facts or violate the law to file a case, investigate, prosecute or make a judgment against a person who knows that there is no criminal fact or should not be investigated for criminal responsibility according to law;
2. knowingly forging, concealing, destroying evidence or concealing facts by other means or breaking the law, deliberately shielding from filing a case, investigating, prosecuting or trying;
3. By forging, concealing, destroying evidence or other means of concealing facts and violating the law, deliberately prosecuting people with serious crimes lightly, or prosecuting people with minor crimes severely;
4. Whoever conceals facts or violates the law by forging, concealing or destroying evidence or other means after filing a case shall take compulsory measures instead of compulsory measures, or after taking compulsory measures, the investigation is suspended or no measures are taken beyond the statutory time limit, and the compulsory measures are actually left unattended, or are revoked or changed illegally, so that the criminal suspect and defendant are actually out of the investigation and control of the judicial organs;
5. Deliberately violating facts and laws in criminal trial activities, and making a judgment or ruling that perverts the law, that is, finding guilty and innocent, and sentencing a felony lightly or a misdemeanor severely;
6, other perverting the law should be investigated for criminal responsibility.
Article 397 of the Criminal Law of People's Republic of China (PRC) Crime of Abuse of Power Crime of Dereliction of Duty Any functionary of a state organ who abuses his power or neglects his duty, thus causing heavy losses to public property and the interests of the state and the people, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. Where there are other provisions in this Law, such provisions shall prevail.
Any functionary of a state organ who engages in malpractices for personal gain and commits the crime mentioned in the preceding paragraph shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years. Where there are other provisions in this Law, such provisions shall prevail.
