First of all, I tell you for sure, call the police.

There is a classic advertising slogan for free prostitution: Ask the police if you have any questions. Of course, you don’t have to call the police for everything! But what we are talking about today falls into the category where the police can be found.

The police generally have two requirements for filing a case.

1. The criminal facts exist;

2. The criminal facts shall be investigated for criminal responsibility in accordance with the law. If there are criminal facts but the law stipulates that criminal liability is not pursued, the case cannot be filed.

Let’s look at the first point. There are criminal facts. So is it a crime to insult others in a WeChat group?

Let us take a look at some relevant provisions of our country's laws:

Article 42 of the "Public Security Administration Punishment Law" who openly insults others or fabricates facts to slander others shall be sentenced to not more than five days Detention or a fine of not more than 500 yuan; if the circumstances are serious, the person shall be detained for not less than five days but not more than ten days, and may also be fined not more than 500 yuan.

Article 246 of the Criminal Law: Anyone who openly insults others by violence or other methods or fabricates facts to slander others, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance, or deprivation of political rights. The crimes in the preceding paragraph, except those that seriously endanger social order and national interests, will only be dealt with if the person is informed.

Obviously, maliciously insulting others in a WeChat group is an act of openly insulting others in public, publicly belittling their personality, and damaging their reputation. This is illegal!
