Legal basis: Article 276 of the Criminal Procedure Rules of the People's Procuratorate handles a case of pleading guilty and admitting punishment. The people's procuratorate should take whether the criminal suspect has reached a settlement or mediation agreement with the victim, or compensated the victim for the loss, obtained the victim's understanding, or voluntarily assumed the responsibility of repairing and compensating the public welfare damage as an important consideration in making sentencing suggestions. The suspect voluntarily pleaded guilty and was willing to actively compensate for the losses. However, if the victim's claim for compensation is obviously unreasonable and a settlement or mediation agreement cannot be reached, it generally does not affect the lenient treatment of the criminal suspect. For a public prosecution case that meets the applicable conditions of the parties' reconciliation procedure, if the criminal suspect pleads guilty and admits punishment, the people's procuratorate shall actively urge the parties to reach a settlement voluntarily. The settlement agreement and understanding opinions issued by the injured party shall be transferred with the case. If the victim meets the conditions for judicial assistance, the people's procuratorate shall actively coordinate and handle it.
