Article 42 When an infectious disease breaks out and is prevalent, the local people's governments at or above the county level shall immediately organize forces to prevent and control it in accordance with the prevention and control plan, and cut off the transmission route of the infectious disease. When necessary, it shall be reported to the people's government at the next higher level for decision, and the following emergency measures may be taken and announced:
(1) Restrict or stop fairs, theatrical performances or other crowd gathering activities;
(2) suspension of work, business or classes;
(three) closed or sealed public drinking water sources, food and related items contaminated by infectious disease pathogens;
(4) controlling or culling wild animals, domestic animals and poultry infected with the epidemic;
(five) closed places that may cause the spread of infectious diseases. When the people's government at a higher level receives the report of the people's government at a lower level on taking the emergency measures listed in the preceding paragraph, it shall make a decision immediately. The lifting of emergency measures shall be decided and announced by the original decision-making organ.
Two. Time limit for handling related cases during the epidemic.
According to the provisions of the Criminal Procedure Law on the calculation of the period, if the last day of the period is a holiday, the first day after the holiday shall be the expiration date of the period, but the detention period of criminal suspects, defendants and criminals shall be based on the expiration date of the period and shall not be extended due to the holiday. For criminal suspects who are not in custody, the time limit for examination and arrest is the first day after holidays. If a criminal suspect in criminal detention fails to make a decision on arrest at the expiration of his detention period, the compulsory measures shall be changed or lifted. In the stage of examination and prosecution, if a criminal suspect is detained, the time limit for handling the case shall be limited to the second return for supplementary investigation and the third extension for examination, and the return and extension shall be based on the principle of compliance with legal provisions and objective needs.
