Legal aid institutions and their staff members shall be punished according to law in any of the following circumstances:

(2) collecting property in handling legal aid cases;

(3) engaging in paid legal services;

(4) embezzlement and misappropriation of legal aid funds.

the property collected in handling legal aid cases shall be ordered to be returned by the judicial administrative department; The illegal income from engaging in paid legal services shall be confiscated by the judicial administrative department; Those who embezzle, privately divide or misappropriate legal aid funds shall be ordered to recover by the judicial administrative department. If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

Article 27 If a law firm refuses to be assigned by a legal aid agency and fails to arrange its lawyers to handle legal aid cases, the judicial administrative department shall give it a warning and order it to make corrections; If the circumstances are serious, it shall be punished by suspending business for rectification for more than one month and less than three months.

Article 28 If a lawyer has any of the following circumstances, the judicial administrative department shall give him a warning and order him to make corrections; If the circumstances are serious, he shall be punished for stopping practicing for more than one month and less than three months:

(1) refusing to accept or terminate legal aid cases without justifiable reasons;

(2) collecting property when handling legal aid cases.

if there is any illegal act mentioned in item (2) of the preceding paragraph, the judicial administrative department shall order it to return the illegally obtained property, and may concurrently impose a fine of not less than times but not more than 3 times the value of the confiscated property.

Article 29 A lawyer who violates professional ethics and practice discipline in handling legal aid cases shall be punished in accordance with the provisions of the Lawyers Law.

Article 3 Any staff member of the judicial administrative department who abuses his power, neglects his duty or engages in malpractices for personal gain in the supervision and management of legal aid shall be given administrative sanctions according to law; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.
