Can the two defendants jointly entrust the same lawyer?

Legal analysis: 1. In criminal proceedings, lawyers cannot act as defenders for more than two defendants in the same case at the same time. This provision is made because in the same case, several defendants have different positions and roles in the case, and their interests are both consistent and conflicting. In the same case, if a lawyer defends multiple defendants at the same time, it may put the defender in a contradictory position and it is difficult to safeguard the legitimate rights and interests of multiple defendants at the same time.

2. In civil litigation, if two or more defendants are * * * co-obligors, and their rights and obligations are combined into one, which does not involve the redistribution of interests, such as the property or infringement cases of husband and wife as * * * co-defendants, they shall be handled according to the general principles of the Civil Procedure Law and allowed to entrust the same lawyer to represent the litigation; If more than two defendants are joint obligors, the legal rights and obligations need to be redistributed. For example, in the case of damages between * * and the infringer as the defendant, although there is temporary consistency in the litigation against the other party, it involves the future redistribution of interests between the parties.

Legal basis: Article 33 of the Criminal Procedure Law of People's Republic of China (PRC). In addition to exercising the right of defense, criminal suspects and defendants may also entrust one or two people as defenders. The following persons may be entrusted as defenders:

(1) lawyers;

(2) A person recommended by a people's organization or the unit to which the criminal suspect or defendant belongs;

(3) Guardians, relatives and friends of criminal suspects and defendants.

A person who has been sentenced to punishment according to law or deprived of or restricted personal freedom shall not act as a defender.

A person who has been dismissed from public office or has his lawyer's or notary's practice certificate revoked may not act as a defender, except the guardian or near relative of the criminal suspect or defendant.
