The court held that Xu illegally added toxic and harmful substances prohibited by the state in food to Chili oil, which not only constituted a criminal offence, but also posed a potential threat to the health and life safety of many consumers and harmed the interests of the public, and should bear corresponding civil liability. According to the provisions of the second paragraph of Article 55 of the Civil Procedure Law of People's Republic of China (PRC) and the first paragraph of Article 20 of the Interpretation on Several Issues Concerning the Application of Law in Procuratorial Public Interest Litigation Cases. The People's Procuratorate of Lanzhou New District has the right to file a civil public interest lawsuit against acts that infringe upon the legitimate rights and interests of many consumers in the field of food safety. After reviewing all the case materials and performing the pre-litigation announcement procedure, our hospital, with the approval of Lanzhou People's Procuratorate, filed a criminal incidental civil public interest lawsuit with Lanzhou New District People's Court according to law. At present, the court has accepted the case.

The national standards for food safety shall be formulated and promulgated by the health administrative department of the State Council in conjunction with the food safety supervision and administration department of the State Council, and the national standard number shall be provided by the standardization administrative department of the State Council. The limits of pesticide residues and veterinary drug residues in food and their inspection methods and procedures shall be formulated by the health administrative department of the State Council, the agricultural administrative department of the State Council and the food safety supervision and management department of the State Council. Rules for inspection of livestock and poultry slaughter shall be formulated by the administrative department of agriculture of the State Council in conjunction with the administrative department of health of the State Council. The formulation of national food safety standards should be based on the results of food safety risk assessment, fully consider the results of edible agricultural products safety risk assessment, refer to relevant international standards and international food safety risk assessment results, announce the draft national food safety standards to the society, and listen to the opinions of food producers, operators, consumers and relevant departments.
The national standards for food safety shall be examined and approved by the food safety national standards review committee organized by the health administrative department of the State Council. The National Food Safety Standards Review Committee is composed of experts in medicine, agriculture, food, nutrition, biology and environment, and representatives from relevant departments, food industry associations and consumers' associations in the State Council to review the scientific and practical nature of the draft national food safety standards.
