According to Article 240th of the current Criminal Law, whoever abducts and sells women and children shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years and fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated; If the circumstances are especially serious, he shall be sentenced to death and his property shall be confiscated. Article 24 1 stipulates that whoever buys abducted women and children shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance.
The punishment of the two is different, which has been controversial for a long time. Some people think that there is no business without market. It is precisely because the punishment for buyers is not enough that it has long been impossible to cut off the demand chain and condone the crime of trafficking.
During the two sessions, CPPCC member, associate professor of the Law School of Shanghai International Studies University and part-time vice-chairman of Shanghai Women's Federation suggested that buying trafficked persons should be treated as the crime of abducting trafficked persons, especially kidnapping, rape, illegal detention and intentional injury in the crime of abducting and trafficking, which must be punished for several crimes in judicial practice, according to the provisions of the criminal law. She also stressed that the ringleaders who obstruct the rescue by violence, threats and other means should be given more punishment and more than five years in prison.
The NPC deputy, the chairman of Baby Home Volunteers Association and the founder of Baby Home Search Subnet, who has been committed to public welfare for a long time, suggested that not only the buyer and the seller should be treated as the same crime, but also the term of imprisonment for the crime of buying should not be lower than the crime of kidnapping. At the same time, they also suggested that the current starting penalty of kidnapping crime should be raised from 5 years to 10 years.
She also suggested that in order to break the limitation of prosecution of trafficking cases, government departments should hold traffickers (including buyers) responsible for new cases for life, and relevant departments in trafficking areas should establish an assessment mechanism to veto the target assessment of grass-roots governments in new trafficking cases, and the main responsible persons of grass-roots governments should not be promoted within five years.
Deputy to the National People's Congress, president of Guangdong Lawyers Association and director of Guangdong Shenglun Law Firm said that in addition to "the same crime and the same punishment" for buyers and sellers, the relevant expressions of the criminal law should also be revised. Almost at the same time, Yunnan Province held a video conference within the province's public security system, demanding that the accumulated cases of trafficking in women and children be comprehensively sorted out in accordance with the work mode of tackling key cases of homicide cases, with the main leaders of county-level public security organs taking the lead, concentrating superior resources to tackle key problems and fully reducing the accumulated case stock. At the same time, carry out basic investigations, visit and investigate clues that infringe on the rights and interests of women and children in the jurisdiction, and do a good job in investigating cases and rescuing abducted children in accordance with the working idea of "solving cases quickly, solving accumulated cases and supervising major cases".
