Lawyers must pass the legal professional qualification examination and obtain a lawyer's practicing certificate before they can engage in legal work. Article 19 establishes three A partnership law firm that is more than 20 years old and has more than twenty practicing lawyers may establish a branch office. To establish a branch office, an application shall be submitted by the judicial administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the branch office is to be established. Application for establishment of a branch shall be handled in accordance with the provisions of Article 18 of this Law.
A partnership law firm is liable for the debts of its branch office. Article 37 A lawyer's personal rights in practicing law shall not be infringed upon.
Lawyers do not assume legal liability when expressing representation and defense opinions in court. Exceptions are made for publication that endangers national security, maliciously slanders others, or seriously disrupts court order.
If a lawyer participates in litigation activities and is suspected of committing a crime, the investigation agency shall promptly notify the law firm or lawyer association where he or she works; if a lawyer is detained or arrested, the investigation agency shall notify the lawyer's family in accordance with the provisions of the Criminal Procedure Law. Article 25 When a lawyer undertakes business, the law firm shall accept the entrustment, sign a written entrustment contract with the client, charge unified fees in accordance with national regulations and record them in the account.
Law firms and lawyers should pay taxes in accordance with the law. Article 23 Law firms shall establish and improve systems for practice management, conflict of interest review, charging and financial management, complaint investigation and handling, annual assessment, file management, etc., and supervise lawyers' compliance with professional ethics and practice disciplines in their practice activities.
