Provisions of Benxi Municipality on the Administration of Prohibiting Fireworks and Firecrackers

Article 1 These Provisions are formulated in accordance with the relevant provisions of national laws and regulations and in combination with the situation of this Municipality in order to protect the state and collective property and the personal and property safety of citizens, prevent environmental pollution and maintain social order. Article 2 Pingshan District, Mingshan District, Xihu District and Nanfen District of this Municipality are prohibited areas for fireworks and firecrackers, among which Qiaotou Town, Beitai Township, Wolong Township, Niuxintai Township, Gaotaizi Township, Huolianzhai Township, Shiqiaozi Township, Waishan Town, Xiamatang Town and Sishanling Township have not been listed as prohibited areas for fireworks and firecrackers. Article 3 These Provisions shall apply to any unit or individual in the area where fireworks and firecrackers are prohibited. Article 4 These Provisions shall be implemented by people's governments at all levels. Article 4 The public security organ is the competent department that prohibits the discharge of fireworks and firecrackers. Article 5 State organs, public organizations, enterprises and institutions, residents' committees and villagers' committees shall carry out extensive and in-depth publicity and education among cadres, workers, students, residents and villagers to abide by these provisions and assist public security organs in doing a good job in prohibiting the discharge of fireworks and firecrackers. Article 6 No unit or individual is allowed to produce, carry, store or sell fireworks and firecrackers in areas where fireworks and firecrackers are prohibited. Article 7 Anyone who commits any of the following acts in the area where fireworks and firecrackers are prohibited shall be punished by the public security organ: < P > (1) Anyone who carries fireworks and firecrackers shall be confiscated;

(2) Individuals who set off fireworks and firecrackers shall be fined from 1 yuan to 5 yuan;

(3) If a unit sets off fireworks and firecrackers, it shall be fined from 5 yuan to 2, yuan, and the person directly responsible shall be punished in accordance with the provisions of the preceding paragraph;

(4) Those who produce, store and sell fireworks and firecrackers shall have all the fireworks and firecrackers and their illegal income confiscated, and may be fined between 5, yuan and 2, yuan. Eighth individuals or units directly responsible for serious violations of these provisions shall be punished in accordance with the relevant provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security; Causing property losses or personal injuries to the state, the collective or others, they shall be liable for economic compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 9 If a party refuses to accept the punishment, he may complain to the public security organ at the next higher level within five days after receiving the notice of punishment, and the public security organ at the next higher level shall make a ruling within five days after receiving the complaint; Anyone who refuses to accept the decision of the public security organ at the next higher level may bring a lawsuit to the local people's court within five days after receiving the notice of punishment. Article 1 If a minor or a person without capacity violates these provisions, his guardian shall be responsible for fines or compensation for losses. Eleventh in the city-wide celebration fireworks, decided by the Municipal People's government and issued a notice. Twelfth the specific application of these Provisions shall be interpreted by the Municipal People's government. Thirteenth these Provisions shall come into force as of March 1, 1995.
