Everyone knows that today’s society is a legal society, but who really understands the meaning of this sentence? This sentence is very important, and the construction of a legal society has a long way to go. It is not only the completion of system construction and the improvement of laws, but more importantly, the quality of our citizens has grown simultaneously and legal awareness has continued to improve. In these aspects, our government departments and other relevant departments have made great efforts and achieved good results. The simplest thing is to give your school a legal report today, so that everyone can have more opportunities to understand the legal system and realize that the legal society is closely related to everyone present.

There are two types of common law, one is substantive law and the other is procedural law. Substantive law stipulates the content of the law, such as what consequences your illegal behavior will bring, what crime it constitutes, how many years you will be sentenced, etc. Procedural law is the norm that stipulates how these laws operate, such as how to arrest you after committing a crime, how to examine you, and how to sentence you. Typical substantive laws, such as criminal law, provide for more than 400 crimes, including intentional homicide, arson and robbery. Most of the crimes we usually see are regulated here. This is also an important weapon for our public security department to fight crime! Below we will use some vivid cases to tell you about criminal law, the current situation of juvenile crime in our country and some preventive measures, especially how to protect your rights and interests in daily study and life, how to resist illegal infringement, and how to prevent yourself from derailing!

First, the current characteristics and trends of juvenile crime in my country.

Five new characteristics of juvenile crime

In recent years, juvenile crime in our country has remained high. According to statistics, in 2004, juvenile offenders under the age of 25 accounted for 50% of the total number of criminal offenders in China and 33% of the total number of people detained by public security. Between 1999 and 2004, the number of juvenile delinquents increased by 4.7%, and the criminal case crime rate increased by 4.7%. 1.4 times. At the same time, crimes committed by minors under the age of 18 are on the rise, and the types of crimes are increasing.

Based on the original gang-oriented, intelligent, younger, violent, blind, imitative, impulsive and accidental characteristics, juvenile crime has shown five new characteristics in recent years:

First, idle youth and other groups commit serious crimes. After investigating 2,361 juvenile offenders, the Central Committee of the Communist Youth League found that there were 1,445 idle teenagers, accounting for 61.2%, becoming the main body of juvenile crimes. In large and medium-sized cities, the problem of juvenile delinquency among the floating population is also serious. According to the latest statistics, such criminals account for about 60% of the total crimes in some cities.

Case: Some of the mold apprentices in the western part of our district are from the mountainous areas in the western part of our district, and some are from other places. Some of these people had no knowledge or skills and began to wander around Ximen all day long. As time goes by, they will inevitably turn to crime. Together these people are most likely to form a criminal gang, a simple and loose gang. Almost all the theft gangs I busted were of this type. These people have a simple division of labor, such as picking locks, breaking into doors, airing opinions, and selling stolen goods. There will be relatively fixed people in each position. Over time, these people will become more skilled in their respective positions.

Secondly, the crime situation among teenagers between the ages of 14 and 16 is becoming increasingly prominent. According to statistics, in the past five years, the proportion of teenagers aged 14 to 16 in all juvenile crimes has increased year by year.

Case: Last year I arrested a theft gang and arrested 13 people. One of them, "Little Anti-aircraft Cannon", was only 15 years old, and the other two were less than 16 years old. He is the leader of the gang. Under his leadership, the gang is crazy about stealing copper and motorcycles in Huangyan.

Starting on the night of Typhoon Yunna, more than 50 copper pieces worth 200,000 yuan and 30 motorcycles worth 6.5438 million yuan were stolen in just two months. Except for one Sichuanese, the other members of this gang are Huangyan locals and a * * * fellow villager. The characteristic is that their family is in the western mountainous area and their family conditions are relatively poor. I usually learn to make molds, but these people are unwilling to work hard, just want to enjoy themselves, and want to get rich quickly!

Third, the crime of property infringement is serious. At present, robberies, snatchings, and thefts account for 71% of the total number of crimes committed by minors, and thefts and snatchings always rank among the top two.

Case: The crimes just mentioned are all crimes of theft, which refers to the act of stealing public and private property in a secret way. The crime of robbery refers to the act of robbing public or private property by violence, coercion or other means. The crime of robbery refers to the act of openly robbing a large amount of public or private property for the purpose of illegal possession. The similarities between these three crimes are that their criminal motives are all illegal possession of other people's property, but the methods used are completely different, and the circumstances of the crime are also very different. In particular, robbery is a felony and can be sentenced to death. The Xinjiang people who committed the most crimes some time ago were typical robbery crimes. There are powerful criminal gangs behind these Xinjiang children. They have a strong sense of law. They use these children who are under the age of criminal responsibility to commit crimes and get away with it. Coupled with the language barrier, it is very difficult to solve the case.

Fourth, juvenile crime has increased due to illegal Internet cafes, drugs and other negative factors. According to the latest statistics, juvenile crime caused by bad information spread on the Internet has increased more than five times. The Internet has almost changed the lifestyle of many minors and occupies most of their spare time. Of course, we do not deny the convenience and efficiency brought by the Internet. It has also made outstanding contributions in helping students learn. But many people are addicted to the Internet and games and can easily go astray. Internet cafes have become serious breeding grounds for crime, just like the video game concert halls of the past. Teenagers with nothing to do always like to be obsessed with it like flies. The popularity of online games has gathered high-level popularity. Those thieves who operate in the middle of the night basically spend the first half of the night in Internet cafes. Some suspects even use QQ to contact them and agree on a time to commit the crime. Such an environment is also extremely detrimental to the growth of teenagers, and people are easily affected by the environment. Therefore, it is recommended that students treat Internet cafes correctly.

Case: Lily, a 17-year-old girl from a middle school in Baoji? Pseudonym, she is very beautiful. Around October last year, she loved the Internet and met a 17-year-old girl Huang who lived somewhere in the urban area of ??Baoji and became a netizen who talked about everything. 65438 On the evening of February 27 last year, Huang and his two "eldest brothers" Kong Haigang and Boring discussed calling their female netizens and agreed that no matter who they asked out, as long as they were beautiful, they could "enjoy fun" together. Huang made an appointment with Lily, a female online friend she knew. Lily also brought her female classmate Wang. After Huang deceived Lily and others into a house in Xiguan, Baoji, Huang hugged Lily and wanted to have sex with her. After being rejected, Huang's "eldest brother" Kong Haigang immediately threatened him, either to stay with Huang or for the three of them to take turns raping her. Forced to do anything, Lily had to choose Huang, a netizen she knew. At this time, Huang's other "big brother" Yang Hongfang took Lily's hand and forcibly pulled her up. Later, Lily told another young man she knew because she couldn't stand Huang's constant phone calls. Lily was asked to make an appointment with Huang and others to discuss the matter in private. An argument broke out and Huang pulled out a switchblade and stabbed him eight times. After receiving the report, Baoji police rushed to the scene and arrested Huang and others. This * * * case was brought out during the review. The Jintai District Court recently found that the facts of the crime were clear after a trial, and sentenced Huang to four years in prison for the crime of ***** and injury. Huang's two "eldest brothers" were also sentenced to three years in prison for helping Huang commit suicide.

Fifth, family problems and school dropout problems have a significant impact on juvenile crime. In recent years, the number of families that have lost harmony, education, morality, and talent has gradually increased. The latest statistics show that the crime rate of children from divorced families is 4.2 times that of healthy families. Nearly 60% of juvenile delinquents are children of single parents. Children of single parents often develop withdrawn and closed characters, which is inevitably related to the fact that they start to embark on the path of crime after being raised.

Family education plays an important role in the entire education system. The image of parents directly affects the image of their children. The failure of family education leads many people to commit crimes.

Case: You may still remember the most famous Jinhua Xu Li murder case. This is the most typical case of family education failure. In 2000, Xu Li was still an ordinary student in Jinhua No. 4 Middle School. His parents have high expectations for him and clearly require him to get top ten grades. His father has been doing business in other places for many years, and his mother is very strict with her son at home and often goes to school to supervise him. Xu Li likes to play ball, but his mother firmly refuses to let him. Because of these reasons, his mother and Xu Li had a tense relationship, and his mother often beat Xu Li. Xu Li's heart was full of depression until the day of the accident. Xu Li wanted to watch football, but her mother violently blocked his wish, causing Xu Li to hit her mother on the head with a hammer and kill her.

Second, crime prevention in real life.

First, personal prevention. As young students, as a knowledgeable group, we have no reason not to learn all kinds of knowledge, including actively learning legal knowledge. Although we currently do not offer legal courses, there are many opportunities to involve the law, so we kindly ask everyone to cultivate an awareness of knowing and abiding by the law. Our country has public security, procuratorate, courts and other law enforcement departments that specialize in combating criminal activities. If you encounter criminal activities, you should call 110 immediately. If you encounter a fire or other dangerous situation, you should also call the police. It is every citizen’s obligation to call the police truthfully and it is also a responsible attitude towards society. I would like to make the following suggestions on the self-protection of minors:

1. Minors protect themselves.

Crime is generally divided into two types: financial torts and torts. The infringement type refers to the purpose of possessing your property, such as theft, robbery, etc. The tort type refers to the purpose of violating your rights, such as killing, injuring, etc. For different types of crimes, I provide the following countermeasures for your reference:

a) Try to avoid going out alone, especially at night, in unfamiliar places or when you are in a bad mood.

b) Do not expose the valuables you carry and carry them close to your body. Don’t carry too much cash and make it a habit to use your credit card. I believe that you are all high-quality talents.

c) Avoid Internet cafes, entertainment venues and other places that are not suitable for minors. Those places are crowded with dragons and dragons, and the public security is the most chaotic.

d) Mind your own business. Many people were harmed by interfering with their own business.

e) Don’t cause trouble. Some people like to use their own people to say immoral things to others, especially girls or couples, and they end up being insulted by the other party.

f) Don’t take advantage. Many people are infringed because of their mentality of taking advantage of others. A typical example is that many of our scammers set up traps. Once you get in, you will suffer a loss. (Such as throwing objects to defraud)

g) Don’t trust strangers at will. Don't easily believe what strangers say, you must think carefully. If you have questions, you might as well discuss it with the people around you.

h) Don’t be smart. Many times, it is some smart and self-righteous people who lead to serious consequences.

I) When you are violated, you must keep a clear mind and find ways to seek help or escape.

2. Adult responsibilities.

a) Social responsibility. Although you are a minor, first of all you are a human being, but you are just a little smaller. Most of the time you should be a man too, right? Society has given you so many rights, and the country has created such a beautiful environment for you. You must know how to repay. This is social responsibility: it is your moral responsibility to collect money, sacrifice yourself, and help others, and it is your legal responsibility not to commit crimes.

b) Collective responsibility. You live in a collective and you can't live without the collective for the rest of your life. From elementary school to middle school to university, you work and live with many people in different jobs. So whether you have this concept is directly related to the quality of your life. You must have personal experience, such as the relationship between deskmates and deskmates, whether you have good friends, getting along with the opposite sex, getting along with teachers, etc. , will have a different impact on your study and life. c) Family responsibilities.

Their behavior directly affects your behavior, but I have to correct one thing for you. You are also an important member of the family. Don't think that your position is the most important emperor, your responsibility is really the most comfortable prince! Families often change their contact patterns because of their children. You actually play an important bonding role in the family. Some students may have a deep understanding of this. When parents quarrel, the effect of children going out to dissuade them is particularly obvious, so you must also shoulder the responsibility of the family and create a good environment for the family.
