I. Professional experience
In 2004, I was admitted to Beijing Dacheng Law Firm and started my lawyer career. From June 5438 to October 2008, I graduated from China University of Political Science and Law with a bachelor's degree in law. In September 2009, when I was an intern in Beijing Dacheng Law Firm, I found that many interns were one person with two roles. Many interns even complete the whole case by themselves, leaving only one case file to deal with the remaining tasks. Many interns are unable to complete the case, which also adds a lot of workload to themselves. 2011/During my internship in Beijing Dacheng Law Firm, I learned that Beijing implemented the measures of "no beating, mutilation, restriction of personal freedom, frequent abuse and intimidation of women and children", and I had an illusion that the original law did not allow us to do so, but we could have done so, so I chose to resign and start my own business.
Second, the achievements made
20 17 participated in the first personal safety protection order case in Beijing. In the process of representing cases, my wife and I have done a lot of work, including asking for legal aid (not limited to perpetrators) and psychological counseling for victims of domestic violence. 20161month, China Women's Development Foundation released "20 13-20 15 Ten Cases of Domestic Violence in Rural Areas of China". In 20/0/7, Kloc was the keynote speaker in a series of lectures on "Happy Family" organized by Beijing Women's Federation, and won the first prize (All-China Women's Federation). June 5438+February of the same year, I signed a contract with the No.1 Family Mediation Center in Chaoyang District, Beijing, and became the first domestic violence mediator. 20 19 served as the first mediator of the National Family Mediation Center of China Women's Development Foundation.
Third, shortcomings
I have many years of practicing experience as a lawyer, but due to my lack of professional knowledge and work skills, I don't understand legal issues, and there are some problems in providing legal services to victims of domestic violence. If some victims don't understand legal knowledge and don't know what to do when they encounter legal problems; Some victims may seek legal advice because they are afraid that things will hurt their family and friends. Some victims are afraid of trouble and face loss, and dare not complain to the relevant departments and report the abuse after divorce; Some victims are afraid or worried that they will be punished after divorce, and choose to be silent or ignore them; Some victims are afraid to report to the relevant departments for help for fear of retaliation or other reasons; Some victims seek help online instead of through legal channels. Therefore, no matter how to provide legal aid to victims of domestic violence, the victims themselves need to take active actions; After knowing that victims of domestic violence seek help from relevant departments, they should call the police for help in time; When necessary, organize professionals to participate in domestic violence legal services through public interest lawyers; When necessary, legal experts can be invited to participate in domestic violence legal services to further improve their professional level and business ability. Four. any other business
When encountering a legal aid case, the materials to be prepared include: a copy of the aided person's ID card, the original of the aided person's ID card, a letter of introduction from the law firm entrusted by the aided person, a power of attorney issued by my unit or neighborhood committee, a copy of the aided person's ID card, the original of the power of attorney, and the mailing address and contact information left by the aided person. In some cases, it is impossible to keep copies and copies of relevant materials during the proceedings. For example, in a domestic violence case, the telephone number of the person under investigation or his guardian can be obtained through WeChat, Weibo, news, etc. At the same time, in the process of hearing the case, if the respondent or his guardian applies and meets the conditions of legal aid, the legal aid institution will assign lawyers to provide legal advice and legal help and other related services free of charge. The above is what my team has done for a victimized woman, and I will make more efforts to help more women solve the problem smoothly.
