1. Criminal responsibility: According to the provisions of Article 133 of the Criminal Law, if a serious accident occurs due to violation of traffic regulations, causing serious injuries, deaths or heavy losses to public and private property, a case shall be put on file for investigation.
Whoever, in violation of traffic regulations, has a major accident, resulting in serious injury, death or heavy loss of public or private property, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.
The so-called "major accident" here refers to any of the following circumstances according to Article 2, Paragraph 1 of the Interpretation:
(1) Causing one person to die or more than three people to be seriously injured, and taking full or main responsibility for the accident.
2. Civil liability for compensation: According to the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Personal Injury Compensation Cases, the compensation includes: medical expenses, lost time, nursing expenses, transportation expenses, accommodation expenses, hospital food subsidies, necessary nutrition expenses, disability compensation, disability AIDS, living expenses of dependents, rehabilitation expenses, nursing expenses, follow-up treatment expenses, funeral expenses, death compensation, funeral matters handled by relatives of victims, etc.
