Can a rape trial be held in camera

Rape cases involving personal privacy can be tried in camera. In camera trial refers to the people's court in the conduct of litigation activities, according to the provisions of the law or other justifiable reasons, the case is not open to the judicial trial system.

Legal basis

Article 188 of the Criminal Procedure Law

The trial of a case of first instance by a people's court shall be held in public. However, cases concerning state secrets or personal privacy shall be heard in camera; cases involving commercial secrets may be heard in camera if the party concerned applies for such a hearing to be closed. Cases heard in camera shall be announced in court the reasons for the closed hearing.

Article 285

Cases in which the defendant is under eighteen years of age at the time of trial shall be tried in camera. However, with the consent of the minor defendant and his or her legal representative, the school in which the minor defendant is enrolled and the organization for the protection of minors may send a representative to the trial.
