The work of lawyers in criminal cases is mainly divided into three stages:
The first stage: investigation stage (public security organ stage)
Lawyers accept the entrustment of criminal suspects and their families, meet with criminal suspects, provide legal advice to them, and represent complaints and accusations; If a criminal suspect is detained, he shall apply for bail pending trial;
The second stage: the stage of examination and prosecution (procuratorial stage)
Lawyers accept the entrustment of criminal suspects and their families to act as defenders of criminal suspects, consult, extract and copy relevant materials of cases, meet with criminal suspects, investigate and collect relevant materials of cases, and put forward defense opinions;
The third stage, the trial stage (court stage)
Lawyers act as defendants' defenders, review jurisdiction, consult, extract and copy materials related to cases, meet defendants, defend in court, put forward defense opinions and file appeals;
2. The lawyer's fee for criminal defense mainly considers several aspects: the severity of the defendant's crime, the complexity of the case, the workload of the lawyer and other factors.
3. With regard to the lawyer's fees in the case, it is suggested that the family members bring relevant information and consult and interview the lawyer face to face.
With regard to the payment standard of lawyer's fees, except for a few provinces and cities that have guiding opinions, most of them adopt the method of negotiating fees. Generally speaking, each law firm has its own charging standards, and the lawyer's fees of each law firm and lawyer are different.
Some gaps are still relatively large.
Lawyer fees have the following characteristics:
1. Lawyers shall collect fees uniformly in the name of their law firm, and shall not collect lawyer's fees privately.
Two, the lawyer's fees are different from the funds for handling cases, and the necessary expenses for lawyers to handle entrusted affairs are still borne by the client.
Third, legal fees are different from legal fees. Lawyer's fee is a civil agency fee based on the entrustment relationship, and legal fee is a compulsory fee based on bringing a lawsuit to the court. Lawyers' fees can be negotiated, but not legal fees.
At present, there are three main ways to collect legal fees:
Piece rate. Such as simple legal affairs.
Charge in proportion to the target amount.
Charge by the hour.
The specific charging method and amount shall be agreed by both parties in the contract for hiring lawyers.
