Defendant Li Shide, male, aged 44, was a worker of Qiezixi Meat Joint Factory in Jiulongpo, Chongqing before his arrest. Defendant Zhang Shuming, male, 38 years old, unemployed. 1September 9, 980 was sentenced to three years of reeducation through labor for theft and fraud; 1 September 23, 1983 and 199 1 August 24, 1993 were sentenced to 9 years' imprisonment and1year respectively, and released on August 23, 1993. On June 1998, 1 1, the branch of Qujing District Procuratorate filed a public prosecution with Qujing District Intermediate People's Court. The indictment found the criminal facts of the above-mentioned defendant as follows:1In July 1993, the defendant asked Li Shide to go to Simao to buy drugs, and agreed to pay the travel expenses and drug money. After contact with drugs in August, Li called Simao to remit money. Zhang Shuming first asked his concubine Xue Ping to go to Li Shide with 29,000 yuan of drug money. The two handed the money to Bielinfei (handled separately) to buy drugs, and then Zhang Shuming also rushed to Simao. The Higher People's Court of Yunnan Province held that the facts of the original judgment were clear and the evidence was true and sufficient. The actions of the defendants Li Shide and Zhang Shuming have constituted the crime of drug trafficking. After the defendant Li Shide was arrested, he actively assisted the public security organs in arresting his accomplices. Those who have rendered meritorious service may be given a lighter punishment according to law. Defendant Zhang Shuming committed a new crime within three years after he was released from prison. He is a recidivist and should be severely punished according to law. The reasons for the protest of the procuratorial organs are partially established and should be adopted.
