Article 82: Public security organs may first detain current criminals or major suspects who have any of the following circumstances:< /p>
(1) He is preparing to commit a crime, commits a crime, or is discovered immediately after committing a crime;
(2) The victim or a witness at the scene identifies him as the criminal;
(3) Criminal evidence is found around him or in his residence;
(4) Attempting suicide, running away, or escaping after committing a crime;
(5) Possibly destroying or fabricating evidence Or colluding with others;
(6) Not telling the real name and address, and the identity is unknown;
(7) There is a serious suspicion of committing crimes on the run, committing crimes multiple times, or committing crimes in groups .
Article 85: When detaining a person, the public security organ must produce a detention certificate.
After being detained, the detainee shall be immediately sent to a detention center for detention and shall not exceed 24 hours. Unless notification is impossible or notification of suspected crimes endangering national security or terrorist activities may hinder the investigation, the detainee's family members must be notified within 24 hours after detention. The detainee's family members should be notified immediately after the circumstances that hindered the investigation disappear.
Article 91: If the public security organ considers that a detained person needs to be arrested, it shall submit it to the People's Procuratorate for review and approval within three days of detention. Under special circumstances, the approval time may be extended by one to four days.
For major suspects who commit crimes on the fly, commit crimes multiple times, or conspire to commit crimes, the time for review and approval can be extended to 30 days.
The People's Procuratorate shall make a decision to approve or disapprove the arrest within seven days after receiving the approval letter from the public security organ. If the People's Procuratorate does not approve the arrest, the public security organ shall release the person immediately upon receiving the notice and promptly notify the People's Procuratorate for execution. For those who need to continue investigation and meet the conditions for release on bail pending trial or residential surveillance, they will be released on bail pending trial or placed under residential surveillance in accordance with the law.
