Take the initiative to receive treatment after persuasion and education.

On February 3rd 1, a hospital in the city reported that Zhang Moumou of fancheng district Shipu office was a suspected patient and refused to cooperate with medical treatment. After being educated and persuaded by the police and village cadres of fancheng district Public Security Bureau, Zhang Moumou took the initiative to go to the hospital for isolation treatment.

2. On February 3rd, Jin Dong Campus of the Central Hospital informed that Zhuo Moumou in a certain district of Fan Wei Road in High-tech Zone was a suspected patient and refused to cooperate with medical treatment. After the education and persuasion of the police and community cadres of Gaoxin Public Security Bureau, Zhuo Moumou took the initiative to go to the hospital for isolation treatment.

3. On February 3rd, Jin Dong Campus of Central Hospital informed a community of Diamond Avenue in Xiangzhou District that it was a suspected patient and refused to cooperate with medical treatment. After being educated, persuaded and coordinated by the police of Fancheng Public Security Bureau to solve the difficulties, the patient continued to stay in the hospital to cooperate with the isolation observation.

6. On February 3rd, the Municipal Hospital of Traditional Chinese Medicine reported that six suspected patients who came to see a doctor because of fever did not want to stay in the hospital for isolation treatment and left on their own. After the police of Fancheng Public Security Bureau tried their best to find, educate and persuade, all six people returned to the hospital for isolation treatment.

7. On February 4th, the Central Hospital reported that Luo Moumou in Lushan Town, Xiangzhou District was a suspected patient and requested assistance in finding a doctor. After being educated and persuaded by the police of Xiangzhou District Public Security Bureau, Luo Moumou took the initiative to go to the hospital for isolation treatment.

Compulsory isolation treatment after persuasion and education is ineffective.

On February 4th, fancheng district No.1 Hospital reported that Zhang Moumou, the office of Persimmon Shop, was a suspected patient and asked for help in finding and treating him. The police of Fancheng Public Security Bureau tried their best to find out and assisted medical institutions to send Zhang Moumou to the hospital for compulsory isolation treatment.

4. On February 4th, the Central Hospital reported that Yu Moumou in Lushan Town, Xiangzhou District was a suspected patient and requested assistance in finding treatment. After repeated persuasion by the public security organs, the police of Xiangzhou District Public Security Bureau cooperated with medical institutions and forced Yu Moumou to be sent to the hospital for isolation treatment.

5. On February 4th, the Central Hospital informed that two suspected patients in Yushan Town, Xiangzhou District were unwilling to receive isolation treatment. After repeated education and persuasion by public security organs and relevant departments failed, the police of Xiangzhou District Public Security Bureau cooperated with medical institutions to force two suspected patients to be sent to hospital for isolation treatment.

II. Relevant laws and regulations

According to Article 39 of the Law on the Prevention and Control of Infectious Diseases, patients with infectious diseases, pathogen carriers, suspected patients and close contacts of suspected patients should take the initiative to receive centralized treatment, separate isolation and medical observation from medical institutions. Refuse isolation treatment or leave without authorization before the expiration of the isolation period, the public security organ shall assist the medical institution to take compulsory isolation treatment measures.

According to Article 50 of the Law on Public Security Administration Punishment, those who refuse to carry out the decisions and orders issued by the people's government in an emergency, or obstruct the staff of state organs from performing their duties according to law, shall be punished by public security organs according to law.

According to the provisions of Article 277 of the Criminal Law, whoever obstructs the staff of state organs from performing their duties by violence or threat, but does not use violence or threat, thus causing serious consequences, shall be investigated for criminal responsibility according to the crime of obstructing official duties, and the maximum penalty shall be fixed-term imprisonment of not more than three years.

According to the provisions of Article 330 of the Criminal Law, whoever, in violation of the provisions of the Law on the Prevention and Control of Infectious Diseases, refuses to implement the prevention and control measures proposed by the health and epidemic prevention institutions in accordance with the Law on the Prevention and Control of Infectious Diseases, thus causing the spread of infectious diseases or serious danger of spread, shall be investigated for criminal responsibility according to the crime of obstructing the prevention and control of infectious diseases, and the maximum penalty shall be fixed-term imprisonment of not more than seven years.

According to article 1 of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases of Obstructing the Prevention and Control of Sudden Infectious Diseases, anyone who suffers from sudden infectious diseases or suspected sudden infectious diseases, refuses to accept quarantine, compulsory isolation or treatment, intentionally spreads pathogens and endangers public safety shall be investigated for criminal responsibility according to the crime of endangering public safety by dangerous means, and may be sentenced to life imprisonment or death at the maximum.
