No unit or individual may use its own homestead, buy other people's homestead, use rural learning houses or buy rural collective land to build "small property houses". All "small property houses" under construction or built should stop construction and sales and be demolished by themselves. Otherwise, the district government will organize forced demolition, and those suspected of committing crimes will be transferred to public security organs for criminal responsibility.
Two, peasant apartments can only be allocated to the village (community) or collective village (neighborhood) people. Rural collective economic organizations should plan and build peasant apartments in accordance with the Implementation Opinions on the Management of Rural Villagers' Housing Construction in Chaonan District of Shantou City (Trial), and allocate them to the village (community) or the collective village (residents), and may not sell them to non-members of the collective or sell them in other forms in disguised form, such as rental.
Three, the illegal purchase and rental of "small property houses" are not protected by law. "Small property right houses" are illegal buildings. Without the approval and acceptance of natural resources, housing construction and other departments, it is impossible to register property rights, and it is impossible to carry out forced demolition or house expropriation compensation. Illegal purchase and lease of "small property houses" are not protected by law. Once disputes arise, it will be very difficult for buyers to defend their rights. It is strictly forbidden for any unit or individual to illegally purchase or transfer "small property houses", and all losses and consequences caused thereby shall be borne by themselves. If the circumstances are serious enough to constitute a crime, they shall be transferred to judicial organs for criminal responsibility according to law.
All the "small property houses" under construction are blacklisted for illegal construction. Blacklisted illegal construction, the relevant departments shall not handle business license, housing lease, financial loans and other procedures. , no water supply, power supply and gas supply. Those who go through the relevant formalities without authorization or connect municipal facilities without authorization shall be strictly investigated for the responsibility of relevant departments and competent personnel. The survey, design, construction, supervision and other units involved in the construction of "small property houses" are listed in the "blacklist" of the credit system and notified to the superior industry authorities.
Five, where organizations use collective land to build "small property houses" or support, connive, shield and let the construction units occupy collective land to build "small property houses", state functionaries or town people's governments (street offices), villages (communities) and other responsible persons who participate in or behind the scenes in the construction of "small property houses" shall be severely investigated and punished by the Commission for Discipline Inspection and supervision, and if the circumstances are serious enough to constitute a crime, they shall be transferred to judicial organs for criminal responsibility according to law.
Six, this notice shall come into force as of the date of promulgation.
