Legal basis: Article 175 of the "Regulations on the Procedures of Public Security Organs for Handling Criminal Cases". After the public security organ accepts the case, after review, it is deemed that there are criminal facts that require criminal liability and that it falls within its own jurisdiction. The person in charge of the public security organ at or above the county level shall approve and file the case; if it is believed that there are no criminal facts, or the criminal facts are obviously minor and do not require criminal liability, or there are other circumstances that do not require criminal liability, the case shall be filed with the public security organ at or above the county level. The case will not be filed without the approval of the person in charge of the agency. For the decision made by the accuser not to file a case, the public security organ shall prepare a notice of not filing a case and serve it to the accuser within three days.
