Legal aid refers to a legal guarantee system that legal aid agencies established by the government or lawyers of non-governmental organizations provide legal services for people with financial difficulties or special cases, especially in rural areas.

The people's governments at or above the county level shall incorporate legal aid into the national economic and social development plan and the basic public service system to ensure the coordinated development of legal aid and economy and society.

The people's governments at or above the county level shall improve the legal aid guarantee system, incorporate the relevant funds for legal aid into the government budget at the corresponding level, establish a dynamic adjustment mechanism, ensure the needs of legal aid work, and promote the balanced development of legal aid.

The judicial administrative department of the State Council guides and supervises the national legal aid work. The judicial administrative departments of the local people's governments at or above the county level shall guide and supervise the legal aid work within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective duties, provide support and guarantee for legal aid work.

Article 25 If a criminal suspect or defendant in a criminal case falls into one of the following circumstances and fails to entrust a defender, the people's court, the people's procuratorate and the public security organ shall notify the legal aid institution to appoint a lawyer to defend him:

(2) Persons with vision, hearing and speech disabilities;

(3) Adults who can't fully recognize their behavior;

(4) Persons who may be sentenced to life imprisonment or death;

(5) Defendants in death penalty review cases who apply for legal aid;

(6) The defendant tried in absentia;

(seven) other personnel as prescribed by laws and regulations.

In other criminal cases that are tried by ordinary procedures, if the defendant fails to entrust a defender, the people's court may notify the legal aid institution to appoint a lawyer as a defender.
