Can relatives and friends who are not qualified as lawyers act as second defenders? How to meet the criminals in the prosecution stage?

1. Relatives and friends of criminal suspects who are not qualified as lawyers can be entrusted as defenders, and they can meet the criminal suspects with the permission of the procuratorate during the examination and prosecution stage;

2. Legal basis:

1) the way of defense and the scope of defenders in article 32 of the criminal procedure law (amended by 20 12). In addition to exercising the right of defense, criminal suspects and defendants may also entrust one or two people as defenders. The following persons may be entrusted as defenders:

(1) lawyers;

(2) A person recommended by a people's organization or the unit to which the criminal suspect or defendant belongs;

(3) Guardians, relatives and friends of criminal suspects and defendants.

A person who has been sentenced to punishment according to law or deprived of or restricted personal freedom may not act as a defender.

2) The right to meet and communicate with defenders in the first paragraph of Article 37 of the Criminal Procedure Law (revised 20 12). Defence lawyers can meet and communicate with criminal suspects and defendants in custody. Other defenders, with the permission of the people's courts and people's procuratorates, may also meet and correspond with criminal suspects and defendants in custody.
