If the complainant doesn't want the people's court of first instance to retry, he needs to appeal to the people's court of first instance. Then after writing the reasons, he usually needs to write another sentence: "Please ask the people's court to try the criminal case according to law and make a fair and just legal judgment."
If the complainant files a complaint with the people's court that originally tried the case, he will generally write "Please ask the people's court to retry the criminal case according to law and make a new judgment" at the end.
