What are the qualifications of defenders in criminal cases?
Defender refers to a person who is entrusted by the accused or appointed by the people's court to help the criminal suspect and defendant exercise their right to defense in order to safeguard their legitimate rights and interests. Non-criminal suspects and defendants may entrust one or two people as defenders in addition to exercising their right to defense. According to the law, the following persons can be entrusted as defenders: (1) lawyers; (2) A person recommended by a people's organization or the unit to which the criminal suspect or defendant belongs; (3) Guardians, relatives and friends of criminal suspects and defendants. In addition, those who are not allowed to act as defenders are: 1, people who are being executed or are on probation or parole; 2. Persons deprived or restricted of personal freedom according to law; 3. Persons without capacity or with limited capacity; 4. People's courts, people's procuratorates, public security organs, state security organs and prison staff; 5. People's jurors; 6. People who have an interest in the trial result of this case; 7. Foreigners or stateless persons. A person who has been sentenced to punishment according to law or deprived of or restricted personal freedom shall not act as a defender.
