Article 163 of China's Criminal Procedure Law stipulates that all judgments shall be publicly announced. If a verdict is pronounced in court, it shall be served on the parties concerned and the people's procuratorate that initiated the public prosecution within five days; If the sentence is pronounced on a regular basis, it shall be served on the parties concerned and the people's procuratorate that initiated the public prosecution immediately after the announcement.
Article 104 of the Criminal Procedure Law stipulates that the service of litigation documents must have a service receipt. The recipient himself shall record the date of receipt and sign or seal it. If I am not here, I can collect it from my adult family members or the unit where I work. The payee should write down the date of receipt and sign or seal it. The date of receipt by the recipient himself or his agent is the date of delivery. If the addressee or agent refuses to accept or sign or seal, the addressee may invite a witness to be present to explain the situation, record the reasons and date of refusal on the service receipt, which shall be signed or sealed by the addressee and witness, and the litigation document shall be deemed to have been served if it is left at the domicile or unit of the addressee or agent.
Article 105 If it is difficult to directly serve litigation documents, the people's court where the addressee is located may be entrusted to serve them on his behalf or by post.
Article 106 If the service is entrusted, the power of attorney, the litigation documents entrusted and the service receipt shall be sent to the people's court where the addressee is located. When the entrusted people's court receives the litigation documents entrusted for service, it shall register them, send them to the addressee in time by a special person, and then return the service receipt to the entrusted people's court in time. When the entrusted people's court cannot serve it, it shall promptly inform the entrusted people's court of the reasons for its failure to serve it, and return the litigation documents and the service receipt.
Article 107 If it is served by post, the litigation documents and the service receipt shall be registered and mailed to the addressee. The date indicated on the registered receipt is the delivery date.
It is closely related to personal freedom, so it is best to collect it yourself. Legally, personal matters generally need to be handled by the parties themselves, and others are not allowed to handle them on their behalf. However, there is no law on whether criminal judgment can entrust others to collect it.
