Article 1 These Regulations are formulated in accordance with the relevant laws and regulations and the actual situation of this Municipality in order to strengthen the management of dog breeding, safeguard the health and personal safety of citizens, and maintain public order and the city appearance and environment.
Article 2 Units and individuals that raise and manage dogs within the administrative area of this Municipality shall abide by these regulations.
The management of troops, police dogs, zoos, dogs for scientific research and experiments and other special dogs shall be implemented in accordance with the relevant provisions of the state.
Article 3 The principle of combining management with service, combining law enforcement of administrative organs with participation of grass-roots organizations in management, and combining self-discipline of dog-raising units and individuals (hereinafter referred to as dog owners) with public supervision shall be implemented.
Article 4 The people's governments at all levels shall be responsible for organizing the implementation of these Regulations.
People's governments at all levels shall establish a dog management coordination mechanism composed of public security, animal husbandry and veterinary, urban management, industry and commerce, health and other relevant departments.
Article 5 The public security department is the competent department in charge of dog management, fully responsible for dog supervision and management, specifically responsible for dog registration, rabies killing, sheltering abandoned dogs and wild dogs, and investigating and handling illegal dog raising.
The animal husbandry and veterinary department is responsible for the immunization and quarantine of dogs, the implementation of diagnosis and treatment permits, the organization of harmless treatment of infected dogs and dogs without owners, and the supervision of dog owners for harmless treatment of dog carcasses.
The urban management department is responsible for investigating and dealing with the behavior of selling dogs on the street and destroying the city appearance and environmental sanitation because of raising dogs.
The industrial and commercial department is responsible for the supervision and management of dog business activities.
The management of rabies vaccine injection by the person in charge of health department and the diagnosis and treatment of rabies patients.
Article 6 Community residents' committees, villagers' committees, owners' committees of residential quarters and property management units shall assist in dog-raising management, carry out publicity and education on dog-raising according to law and civilization, formulate a dog-raising convention and supervise its implementation, and mediate disputes caused by dog-raising according to law.
Radio, television, newspapers and other news media should strengthen the publicity of dog management.
Seventh dog industry associations should strengthen industry self-discipline, advocate dog owners to standardize dog-raising behavior, and assist in dog management.
Eighth any unit or individual has the right to discourage or report violations of these regulations to the relevant departments, and have the right to know the investigation results of the report.
The relevant departments shall set up a hotline to receive and handle reports, and commend or reward informants.
Ninth dog registration system. Without registration, no unit or individual may raise a dog.
Implement a compulsory immunization system for dogs according to law. Dog owners shall, in accordance with the relevant provisions of the state, regularly send dogs to animal epidemic prevention institutions for rabies vaccine injection. Those who have not been immunized shall not be registered.
Tenth towns are the key areas of dog management, and rural areas are the general areas of dog management. The specific regional scope shall be announced by the municipal and county people's governments.
Eleventh hospitals (except animal hospitals), schools, kindergartens and dormitory areas are prohibited from keeping dogs. City and county-level city and district people's governments may designate other areas where dogs are prohibited.
Individuals in key management areas are prohibited from raising strong dogs and large dogs. The specific varieties and standards shall be determined by the municipal public security department in conjunction with the animal husbandry and veterinary department and announced to the public.
Article 12 An individual raising a dog shall meet the following conditions: (1) Having a legal certificate of permanent residence or temporary residence in this Municipality; (2) Having full capacity for civil conduct; (three) a single family with a fixed residence and living outside the kennel area; (four) the dog has been immunized and obtained legal and effective proof of immunization.
Thirteenth units to raise dogs should meet the following conditions: (1) because of special needs such as escort and performance; (two) the legal identity certificate of the unit and its responsible person; (three) a sound dog safety management system; (4) Having a safe and reliable kennel, kennel and other facilities; (five) the dog has been immunized and obtained legal and effective proof of immunization.
Fourteenth units and individuals shall solicit the opinions of the local community residents' committees and villagers' committees when raising dogs, and sign a letter of responsibility for raising dogs with the community residents' committees and villagers' committees.
Fifteenth public security departments shall, within fifteen days from the date of accepting the application for raising dogs, review the application and relevant certificates submitted by dog owners. Those who meet the conditions stipulated in Article 12 or Article 13 of these regulations shall be registered and issued with a dog-raising registration certificate and a dog-raising license; Those who do not meet the requirements shall not be registered, and the reasons shall be explained in writing.
Dog registration certificate is valid for one year.
Dogs in key management areas should be implanted with electronic identification marks.
Article 16 If a dog owner who has registered for raising a dog needs to continue to raise a dog, he shall go through the extension formalities with the public security department 30 days before the expiration of the dog registration certificate, with the valid immunization certificate of the dog and the original dog registration certificate.
If the dog owner's domicile is changed, it shall, within 30 days from the date of change, go through the change registration with the public security department with the dog registration certificate.
Dog owners who lose their dog registration certificate and dog license shall apply to the public security department for a replacement within 15 days from the date of loss.
If a dog owner transfers the dog to another person or the dog dies or is missing, he shall go through the cancellation procedures of the dog registration certificate with the public security department within 30 days.
Seventeenth dog owners should pay the management service fee every year. Specific standards shall be formulated by the Municipal People's government and approved by the provincial finance and price departments.
The management service fee is exempted for the blind to raise guide dogs and the disabled to raise support dogs.
The dog management service fee is collected by the public security department, turned over to the state treasury and included in the financial budget management. The funds required for dog management are included in the budgets of relevant departments.
The dog immunization fee is implemented according to the standards approved by the provincial finance and price departments.
Article 18 The public security department shall establish an electronic file for dog registration and record the following items: (1) The name, address and contact information of the dog owner; (2) breed, date of birth and main physical characteristics of the dog; (three) the dog registration certificate number code, issuance time; (four) the continuation, alteration, replacement and cancellation of the dog registration certificate; (five) the time of rabies vaccine injection; (6) Paying management service fees; (seven) illegal dog records; (eight) other matters required by the public security department.
The public security department shall regularly feed back the main information of electronic files to the community neighborhood committees and villagers' committees where the dog owners are located, and the community neighborhood committees and villagers' committees shall publicize them to the residents and villagers.
Nineteenth city, county-level city, district people's government can designate the time and area where dogs are prohibited from traveling during major holidays or major activities and specific areas, and announce them to the public.
Community residents' committees, villagers' committees, and owners' committees of residential quarters can set the time and area where dogs are prohibited from walking in their residential areas, and publicize them to residents and villagers.
Twentieth dogs shall comply with the following provisions:
(a) dogs are not allowed to enter supermarkets, shopping malls (shops), commercial blocks, financial institutions, hotels, restaurants, gardens, parks, public green spaces, institutions, schools, kindergartens, children's activity places, hospitals, libraries, exhibition halls, theaters, stadiums, playgrounds, waiting rooms and other public places;
(2) When taking a dog out, it is necessary to hang a dog tag, tie a dog chain, carry a dog registration certificate, be led by a person with full capacity for civil conduct, or put it in a dog bag, a dog cage, or embrace it, and avoid the elderly, the disabled, pregnant women and children; (three) except for small taxis and human tricycles, dogs are not allowed to take public transport. When taking a small taxi or human tricycles with a dog, the driver's consent shall be obtained;
(4) If you take the elevator with your dog, you should avoid the peak hours of elevator operation;
(five) the strong dogs and large dogs of the unit shall be kept in captivity or in captivity, and shall not go out to walk the dogs;
(6) Dogs shall not pollute the environment. Dogs should be removed immediately when they excrete feces outdoors;
(seven) raising a dog shall not interfere with the normal life of others. When barking affects others, dog owners should take effective measures to stop it;
(eight) shall not abuse or abandon dogs;
(nine) if a dog dies, it shall promptly report to the animal husbandry and veterinary department and make harmless treatment under its supervision;
(ten) to fulfill other obligations stipulated in the dog responsibility book.
Twenty-first business institutions engaged in dog breeding and sales, holding dog exhibitions and providing services such as diagnosis, treatment, beauty, foster care and training for dogs shall handle industrial and commercial registration according to law and file with the public security department.
When raising and selling dogs, it is necessary to do a good job in epidemic prevention in accordance with state regulations, truthfully record the breed, quantity and flow direction of dogs, and accept the supervision and inspection of the animal husbandry and veterinary departments and the public security departments.
It is forbidden to set up dog business premises as stipulated in the first paragraph of this article in residential quarters and office buildings.
Twenty-second dogs hurt others, dog owners should immediately send the victims to medical institutions for treatment, advance medical expenses, and bear civil liability according to law. If damage is caused by the fault of the victim or the third party, the victim or the third party shall bear civil liability according to law. Advocate dog owners to voluntarily take out dog injury insurance.
Twenty-third public security departments to set up a dog reception center, responsible for the reception of dogs in violation of the provisions of this Ordinance and dogs abandoned by dog owners, wild dogs. Dogs accommodated in the dog reception center can be claimed and adopted within seven days from the date of receipt; Unclaimed and adopted, handled by the public security department.
The animal husbandry and veterinary department shall conduct quarantine and epidemic prevention on the dogs in the detention center. If it is necessary to carry out harmless treatment according to law, it shall be handled by the animal husbandry and veterinary department.
Article 24 For dogs that hurt people or are suspected of suffering from rabies, dog owners shall report to the animal husbandry and veterinary department and the health department in time, and cooperate with the public security department to send the dogs to the dog reception center in time, and the animal husbandry and veterinary department shall conduct quarantine inspection; Animal husbandry and veterinary departments shall take extermination measures according to law for dogs diagnosed with rabies, and carry out harmless treatment.
When rabies and other epidemics occur, the municipal, county-level city and district people's governments shall designate epidemic spots and epidemic areas according to the epidemic situation, and take emergency measures such as killing dogs.
Article 25 It is forbidden to forge, alter, transfer or alter certificates and certificates related to raising dogs and engaging in dog business activities.
Twenty-sixth in violation of the provisions of the first paragraph of Article 9 of these regulations, without the registration of a dog, the public security department shall order it to go through the formalities within a time limit, and may impose a fine of not less than 1,000 yuan but not more than 10,000 yuan on the unit, and a fine of not less than 200 yuan but not more than 2,000 yuan on the individual; If it is not handled within the time limit, its dogs will be confiscated.
In violation of the provisions of the second paragraph of Article 9 of these regulations, if dogs are not given compulsory immunization according to law, the animal husbandry and veterinary department shall punish them in accordance with the laws and regulations on animal epidemic prevention.
Article 27 Anyone who, in violation of the provisions of Article 11 of these regulations, raises dogs in no-feeding areas, or raises strong dogs and large dogs in key management areas shall be confiscated by the public security department, and the unit shall be fined between 2,000 yuan and 20,000 yuan, and the individual shall be fined between 500 yuan and 5,000 yuan.
Article 28 Whoever, in violation of the provisions of the first paragraph of Article 16 of these regulations, fails to go through the formalities for renewing the dog registration certificate within the time limit shall be ordered by the public security department to handle it within a time limit, and may impose a fine of not less than 1,000 yuan but not more than 10,000 yuan on the unit and a fine of not less than 200 yuan but not more than 2,000 yuan on the individual; If no correction is made within the time limit, the dog shall be confiscated, the dog registration certificate shall be revoked and the dog license shall be recovered.
In violation of the provisions of the second paragraph of Article 16 of these regulations, those who fail to apply for registration of change within the time limit shall be ordered by the public security department to handle it within a time limit, and may be fined between 500 yuan and 2,000 yuan for the unit and between 100 yuan and 500 yuan for the individual; If no correction is made within the time limit, the dog shall be confiscated, the dog registration certificate shall be revoked and the dog license shall be recovered.
Whoever, in violation of the provisions of the third and fourth paragraphs of Article 16 of these regulations, fails to reissue or cancel the dog registration certificate in accordance with the provisions, shall be ordered by the public security department to go through the formalities within a time limit, and may impose a fine of not less than 200 yuan but not more than 1,000 yuan on the unit and a fine of not less than 50 yuan but not more than 200 yuan on the individual.
Twenty-ninth one of the following acts, shall be given a warning by the public security department, and may impose a fine of 500 yuan to 2000 yuan on the unit and a fine of 50 yuan to 500 yuan on the individual; If the circumstances are serious, the dog shall be confiscated, the dog registration certificate shall be revoked and the dog license shall be recovered:
(a) in violation of the provisions of the first paragraph of Article 19 of these regulations, walking the dog in the period or area where walking the dog is prohibited; (two) in violation of the provisions of article twentieth (a) of this Ordinance, bringing dogs into public places; (three) in violation of the provisions of article twentieth (two) of this Ordinance, the dog has not taken corresponding measures; (four) in violation of the provisions of the twentieth paragraph (three) of this Ordinance, the dog is taken by public transport; (five) in violation of the provisions of article twentieth (five) of this Ordinance, the dogs and large dogs are not tied, kept in captivity or walked out; In violation of the provisions of Item (6) of Article 20 of these regulations, dogs pollute the environment, or fail to remove dog feces in time, the urban management department shall punish them in accordance with the laws and regulations on urban appearance and environmental sanitation management. In violation of the provisions of Article 20 (7) of this Ordinance, if a dog disturbs the normal life of others, it shall be punished by the public security department in accordance with the provisions of the Public Security Administration Punishment Law. In violation of the provisions of Item (9) of Article 20 of this Ordinance, if the dog owner fails to report the death of the dog to the animal husbandry and veterinary department in time, or fails to carry out harmless treatment under its supervision, the animal husbandry and veterinary department shall punish him in accordance with the provisions of laws and regulations on animal epidemic prevention.
Thirtieth in violation of the provisions of the first paragraph of Article twenty-first of this Ordinance, illegally engaged in dog business activities, by the industrial and commercial departments in accordance with the provisions of industrial and commercial management laws and regulations; Failing to file with the public security department, the public security department shall order it to make corrections.
In violation of the provisions of the second paragraph of Article 21 of these regulations, if the producers and operators fail to do a good job in epidemic prevention in accordance with the provisions of the state, the animal husbandry and veterinary department shall punish them in accordance with the laws and regulations on animal epidemic prevention; If the breed, quantity and flow direction of dogs are not recorded truthfully, the public security department shall order them to make corrections.
In violation of the provisions of the third paragraph of article twenty-first, the establishment of dog business premises in residential areas and office buildings shall be punished by the industrial and commercial departments in accordance with the provisions of industrial and commercial management laws and regulations.
Thirty-first in violation of the provisions of the first paragraph of article twenty-fourth, dog owners do not report to the animal husbandry and veterinary departments and health departments in time, and shall be punished according to law. Dog owners do not cooperate with the public security department to send injured or suspected rabies dogs to the detention center, and the public security department shall impose a fine of not less than 1,000 yuan but not more than 10,000 yuan on the unit and a fine of not less than 200 yuan but not more than 2,000 yuan on the individual; If the circumstances are serious, the dog shall be confiscated, the dog registration certificate shall be revoked and the dog license shall be withdrawn.
Article 32 Whoever, in violation of the provisions of Article 25 of these regulations, forges, alters or buys or sells certificates and certificates related to raising dogs and engaging in dog business activities, or buys or sells or uses the above forged or altered certificates and certificates, shall be punished by the public security department in accordance with the provisions of the Law on Public Security Administration Punishment; Those who transfer, alter or forge the dog immunization certificate or the relevant certificates and certificates for engaging in dog business activities may also be punished by the animal husbandry and veterinary department and the industrial and commercial department according to law.
Thirty-third dog owners in violation of these regulations, the public security department confiscated their dogs, revoked the dog registration certificate, and shall not apply for dog registration within three years.
Thirty-fourth public security departments and other relevant departments and their staff have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions by their units or higher authorities according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law: (1) handling dog registration in violation of the provisions of these regulations or deliberately delaying it; (2) Failing to deal with the problems found in law enforcement inspection or the reports received or passing the buck; (three) other dereliction of duty, abuse of power, favoritism.
The thirty-fifth of this Ordinance since March 6, 2007. The Measures for the Administration of Dog Breeding in Suzhou formulated by Suzhou Municipal People's Government on June 30, 2002 shall be abolished at the same time.
