Legal basis:
Provisions of the Supreme People's Court on Several Issues Concerning Evidence in Administrative Litigation Article 24 Where a party applies to a people's court for obtaining evidence, it shall submit an application for obtaining evidence within the time limit for adducing evidence.
The application for obtaining evidence shall include the following contents:
(1) Basic information such as the name and address of the evidence holder; (2) The contents of the evidence obtained; (three) the reasons for applying for evidence collection and the facts of the case to be proved.
Article 17 of "Several Provisions of the Supreme People's Court on Evidence in Civil Litigation" meets one of the following conditions, the parties and their agents ad litem may apply to the people's court for investigation and collection of evidence (1) The evidence applied for investigation and collection belongs to the archival materials kept by the relevant state departments and must be obtained by the people's court ex officio; (two) materials involving state secrets, commercial secrets and personal privacy; (3) Other materials that the parties and their agents ad litem cannot collect by themselves due to objective reasons.
