To apply for practicing as a company lawyer, the following conditions shall be met:
1. Support People's Republic of China (PRC); form
2. Obtaining the legal professional qualification certificate through the national unified judicial examination;
3. Except those who have lawyer practice experience, they must be approved by the listed lawyers association at the prefecture level where the company to practice is located. A company lawyer who meets the requirements of guiding an internship lawyer or hiring a legal adviser will guide the internship for one year and pass the examination of the Lawyers Association;
4. Good conduct;
5. The applicant is a full-time enterprise lawyer engaged in legal affairs in the pilot enterprise.
Note: The lawyer qualification certificate obtained before the implementation of the national unified judicial examination has the same effect as that obtained when applying for lawyer practice. Enjoy the relevant registration conditions and preferential measures for passing the national unified judicial examination and obtain the legal professional qualification certificate. Where the practice of lawyers is restricted by regions, it shall be handled in accordance with relevant regulations.
Handling materials
(1) lawyer's practice certificate report and lawyer's practice registration form;
(2) Copy of legal professional qualification certificate or lawyer qualification certificate, resident identity card and household registration book;
(3) A certificate issued by the public security organ where the household registration is located that the applicant has not received criminal punishment (except negligent crime) before the date of application, and the date of issuance is the applicant's arrival at the municipal judicial bureau; No more than 3 months from the date of submission of application materials.
(4) Registration Form for Examination of Applying for Lawyer Practice in Guangdong Province issued by the Lawyers Association (no need to submit it for those with practice experience);
(5) A copy of the legal professional qualification certificate or lawyer qualification certificate and resident ID card (the copy of the applicant's ID card is provided by the accepting department);
(6) The list of social insurance purchased by the company for the applicant (there is no need to submit proof materials of social insurance list to the window);
(7) The original certificate issued by the unit that agrees to recommend the applicant as a company lawyer and the specific work department of the applicant;
(8) The applicant's recent one-inch dress (non-uniform) bareheaded blue background color photos;
(9) Pre-acceptance notice (or online pre-approval SMS voucher)
Treatment process
1. Application: Log in to the "Online Service Window of Shenzhen Judicial Bureau" of "Guangdong Government Service Network", fill in relevant information online and submit it for online pre-examination. Paper application materials shall be submitted to Shenzhen Administrative Service Hall with the "pre-acceptance notice or SMS certificate passed through online pre-examination".
2. Acceptance: If the application materials are complete and conform to the statutory form, the Shenzhen Municipal Bureau of Justice will accept the application materials on the spot or within 5 working days; If the application materials are incomplete or inconsistent with the statutory form, the applicant shall be informed of all the contents that need to be supplemented at one time; If the application obviously does not meet the statutory requirements or the applicant refuses to make corrections and cannot make corrections, it will not be accepted.
3. Examination and approval: Shenzhen Municipal Bureau of Justice shall conduct examination and approval within 6 working days from the date of acceptance.
4. Examination and approval: Examination and approval shall be conducted within 5 working days after examination and approval, and a decision shall be made on whether to approve or not.
5. Completion: if the license conditions are met, the certificate will be issued within 5 working days and distributed to the municipal administrative service hall; Do not meet the licensing conditions, make a decision not to license, and inform the municipal administrative service hall of the decision in writing, and the relevant results will be published on the website of the Guangdong Provincial Department of Justice.
6. Delivery: The handling personnel shall check the written materials.
