How to obtain a lawyer's practicing certificate

Lawyers must pass the National Judicial Examination to obtain legal professional qualifications. The application conditions are as follows:

1. Have Chinese citizenship and nationality.

2. Support the Constitution of the People's Republic of China and enjoy the right to vote and be elected.

3. Have full capacity for civil conduct.

4. A bachelor's degree in law from an institution of higher learning or a non-law major from an institution of higher learning, with legal professional knowledge.

5. Have good moral character.

From May 2007 to December 31, 2011, the academic requirements for registering for the national judicial examination can be relaxed in the following places:

1. Autonomous counties under the jurisdiction of provinces, autonomous regions, and municipalities directly under the Central Government, Autonomous flags, counties and banners under the jurisdiction of autonomous regions, and counties under the jurisdiction of autonomous prefectures.

2. Key counties (county-level cities and districts) approved by the State Council for national poverty alleviation and development work.

3. Counties under the jurisdiction of 11 provinces, autonomous regions, and municipalities in the western region (except Tibet) (including key counties for provincial poverty alleviation and development work and county-level cities and districts that enjoy ethnic autonomous local policies).

4. Cities, districts, counties, county-level cities and municipal districts under the Tibet Autonomous Region.

Persons under any of the following circumstances cannot register to participate in the national judicial examination. If the registration procedures have been completed, the registration will be invalid:

1. Those who have received criminal punishment for intentional crimes.

2. Those who have been dismissed from public service by state agencies.

3. The lawyer’s practicing certificate has been revoked.

4. According to Article 18 of the "Implementation Measures for the National Judicial Examination (Trial)", those who have been sentenced to a fixed-term imprisonment of less than 2 years are not allowed to register for the national judicial examination, and the period has not expired; or they have been sentenced to life. Those serving a prison sentence are not allowed to register for the national judicial examination.
