The term "rural homestead" as mentioned in these Measures refers to the rural collective construction land obtained by rural villagers in accordance with the law for building houses and ancillary facilities, including houses, ancillary houses and courtyards. Rural villagers' housing construction refers to the behavior of rural villagers to build, rebuild and expand individual housing on newly-built or existing homesteads.
The competent department of natural resources at the county level may entrust the rural construction planning permission involving the construction of rural villagers' houses to the township (town) people's government and sub-district offices according to law.
The people's governments at or above the county level shall strengthen the overall leadership of the management of rural villagers' housing construction within their respective administrative areas, clarify the management institutions, implement the management personnel, and incorporate the required funds into the fiscal budget at the corresponding level.
The agricultural and rural departments are responsible for the reform and management of rural residential land, establish an information platform for residential land management, improve the management system of residential land, and standardize the supervision of residential land. The natural resources department is responsible for coordinating the scale and layout of the homestead land in the land spatial planning, preparing the homestead land planning separately according to the land demand of "one household, one house", and handling the formalities of agricultural land conversion approval, planning permission, real estate registration and so on according to law. The housing and urban-rural construction department is responsible for compiling the general atlas of rural villagers' housing construction, strengthening the guidance of rural architectural style, providing consulting services and technical guidance on the on-site construction and quality and safety of rural housing construction, and carrying out the training and management of rural craftsmen. The public security department is responsible for guiding the issuance of farmhouse key cards. Cultural relics protection, forestry, water conservancy, electric power and other departments shall, in accordance with their respective responsibilities, do a good job in the construction and management of rural villagers' houses.
The people's government of a township (town) and the subdistrict office are responsible for establishing an external acceptance window and an internal multi-sector linkage system for the joint examination and liaison of rural homestead construction, and coordinating the planning and site selection, administrative examination and approval, on-site setting-out, dynamic inspection, quality supervision and completion acceptance of rural villagers' residential construction. Village-level organizations are responsible for drafting village rules and regulations for rural villagers to build houses, doing a good job in the audit and publicity of villagers' building houses, coordinating the vacating, adjustment and paid use of rural homesteads, and guiding villagers to implement rural villagers' building activities according to law.
Legal basis: Article 30 of the Regulations on Land Management in Guizhou Province stipulates that the quota of rural villagers' housing land (including the area of the original housing homestead and the land for ancillary facilities) is:
(1) Suburb and bazi area: no more than130m2 per household;
(2) Hilly areas: each household shall not exceed 170 square meters;
Mountainous areas and pastoral areas: no more than 200 square meters per household.
