Penalties for forging and selling diplomas
Whoever forges the seal of an institution of higher learning to issue academic qualifications and degree certificates shall be convicted and punished for the crime of forging the seal of an institution of higher learning in accordance with the provisions of the second paragraph of Article 280 of the Criminal Law.
Whoever knowingly sells academic qualifications and degree certificates forged by the seals of institutions of higher learning shall be punished as the * * * offender of the crime of forging the seals of institutions.
According to this, it can be clear that there are actually only two kinds of punishment for the crime of forging the seal of public institutions:
Forgery and intentional sales.
Although buying and using fake diplomas does not constitute a criminal offence at present, they still face administrative detention and fines. According to the second paragraph of Article 52 of the Law on Public Security Administration Punishment: "Whoever buys, sells or uses forged or altered academic certificates of institutions of higher learning shall be detained for more than 10 and less than 15, and may also be fined less than 1000 yuan; If the circumstances are minor, they shall be detained for more than 5 days 10 days, and may be fined up to 500 yuan. " Therefore, those who buy and use fake diplomas shall be investigated for corresponding administrative responsibilities according to the seriousness of the case.
There are many reasons why fake diplomas are repeatedly banned in China:
First, a diploma is a "stepping stone" to employment. No matter government departments, institutions or enterprises, there are requirements for diplomas, and there is a fake market if there is demand;
Second, because the illegal cost is low. At present, it costs several hundred yuan to get a fake certificate in the market. More importantly, due to the lack of effective supervision of fake diplomas, even if they are discovered, users do not have to bear too many illegal costs. Therefore, we can learn from foreign practices and increase the punishment for those who use fake diplomas.
From what aspects can we identify the authenticity of academic qualifications?
Fake diplomas have brought great trouble to employers. Before signing a contract with a job seeker, the employer should check the job seeker's education and diploma online or with the relevant departments. "China Higher Education Student Information Network" is the only website to inquire about China's higher education diploma, and "National College Student Information Consultation and Employment Guidance Center" is a specialized institution authorized by the Ministry of Education to carry out higher education diploma certification. However, the above-mentioned inquiry certification qualifications are charged according to the graduation years. In addition, you can also directly check your school or go to the local talent service center (market) to verify the authenticity of the diploma.
Legal basis:
According to Article 52 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment, anyone who commits one of the following acts shall be detained for more than 10 days and less than 15 days, and may be fined less than 1,000 yuan; If the circumstances are relatively minor, they shall be detained for more than five days and less than ten days, and may be fined not more than five hundred yuan:
(1) Forging, altering or buying or selling official documents, certificates, certification documents and seals of state organs, people's organizations, enterprises, institutions or other organizations;
(2) buying, selling or using forged or altered official documents, certificates and supporting documents of state organs, people's organizations, enterprises, institutions or other organizations;
(3) Forging, altering or reselling tickets, boat tickets, air tickets, tickets for cultural performances, sports competitions or other valuable tickets;
(4) Forging or altering a ship's registration number, trading or using a forged or altered ship's registration number, or altering a ship's engine number.
