In order to strengthen the construction of engineering cost consulting market in our province, standardize the practice behavior of engineering cost consulting enterprises in other provinces, and maintain the order of the construction market, these measures are formulated in accordance with the Measures for the Administration of Engineering Cost Consulting Enterprises (Decree No.23). The Ministry of Construction 149) and the relevant regulations on the management of engineering cost consulting industry in our province.
Article 1 These Measures are applicable to engineering cost consulting enterprises from outside the province who enter Henan to engage in engineering cost consulting activities, and register individual businesses and branches in Henan.
Article 2 The term "engineering cost consulting enterprises outside the province" as mentioned in these Measures refers to engineering cost consulting enterprises with qualification certificates issued by the competent departments of housing and urban and rural construction, and the registered place of business license of enterprise as a legal person is not within the administrative area of Henan Province.
Article 3 If an engineering cost consulting enterprise outside the province undertakes business in our province and records a single business, it shall report to the competent department of housing and urban-rural construction of the city or county under the provincial jurisdiction within 15 days from the date of undertaking business (or intending to undertake business), and report to the provincial department for preliminary examination within 30 days.
The following materials shall be submitted for the record:
(1) Record Form for Undertaking Project Cost Consulting Business in Henan (Annex 1) in triplicate;
(2) a copy of the business license of the enterprise as a legal person, and the original inspection;
(three) the original copy of the qualification certificate (copy) of the project cost consultation;
(four) to undertake the project cost consulting contract of Henan province;
(five) a list of full-time professional and technical personnel involved in undertaking business;
(six) the credit certificate issued by the housing and urban-rural construction department of the province (municipality directly under the central government) where the enterprise headquarters is located in the past two years (it is required to indicate the record of no bad behavior in the past two years and the conclusion of regular inspection or review of qualifications in the previous year).
Article 4 The Provincial Department of Housing and Urban-Rural Development shall put on record according to the preliminary examination opinions.
Fifth engineering cost consulting enterprises outside the province can engage in engineering cost consulting activities in Henan Province after completing the registration and filing.
Article 6 If an engineering cost consulting enterprise outside the province sets up a branch in our province, it shall, within 20 working days from the date of obtaining the business license of the branch, go to the Provincial Department of Housing and Urban-Rural Development for the record.
The following materials shall be submitted for the record:
(1) Filing Form for Establishment of Branches of Engineering Cost Consulting Enterprises (Annex II) in triplicate;
(two) the business license of the engineering cost consulting enterprise and its branches;
(three) the qualification certificate of the engineering cost consulting enterprise (copy);
(4) Copies of the registration certificates of not less than 3 registered cost engineers who intend to practice in branches;
(five) the enterprise credit certificate issued by the administrative department of housing and urban-rural construction at the provincial (municipality directly under the central government) level where the enterprise headquarters is located;
(6) The post-holding documents of the person in charge of the branch;
(7) Property right certificate or lease contract of the fixed office space of the branch (per capita office area is not less than 10 square meter);
Article 7 A branch shall, after obtaining the record receipt from the provincial housing and urban-rural construction department, submit the above-mentioned record materials and a copy of the record receipt to the housing and urban-rural construction department where the branch is registered for industry and commerce for the record within 10 working days.
Branches and employees should be included in the management of local housing and urban-rural construction departments.
Article 8 The annual examination system shall be implemented for the registration and filing of branches in Henan Province. Within the validity period, enterprises that undertake engineering cost consulting business in our province and have no bad behavior records need to continue to engage in engineering cost consulting activities in Henan, and should apply to the provincial housing and urban and rural construction authorities for extension of registration in Henan 30 days before the expiration of the validity period. If the application materials for annual review are not submitted within the time limit, the registration in Henan will automatically become invalid after the expiration of the validity period.
Article 9 Where a branch company engages in the engineering cost consulting business, the engineering cost consulting enterprise that established the branch company shall be responsible for undertaking the engineering cost consulting business, signing the engineering cost consulting contract and issuing the engineering cost achievement document.
Branches may not undertake engineering cost consulting business in their own names, conclude engineering cost consulting contracts, and issue engineering cost achievement documents.
Article 10 If the contents of the person in charge, full-time technical personnel and office space of a branch are changed, it shall, within 30 days from the date of change, go to the competent department of housing and urban and rural construction where the industrial and commercial registration is located with relevant supporting documents for the record, and report to the competent department of housing and urban and rural construction of the province for the change procedures.
Article 11 If an engineering cost consulting enterprise outside the province needs to cancel its branch due to bankruptcy, closure, cancellation or closure, it shall, within 15 days after going through the industrial and commercial cancellation procedures, go through the cancellation registration procedures with the Provincial Department of Housing and Urban-Rural Development.
Article 12 After obtaining the registration formalities in Henan Province, the branch company shall be incorporated into the integrity file system of project cost management in Henan Province, and the relevant information and data of the enterprise and the branch company shall be entered into the integrity file library to accept the annual assessment of integrity evaluation.
Thirteenth provincial engineering cost consulting enterprises do not go through the registration formalities according to the requirements of these regulations or have illegal acts in the practice process, which will be included in the bad behavior record. If the circumstances are serious, the qualification for filing shall be cancelled.
Fourteenth approach by the Henan Provincial Department of housing and urban-rural development is responsible for the interpretation of. Its registration is entrusted to Henan Construction Engineering Standard Quota Station.
Fifteenth these Measures shall come into force as of the date of promulgation.
