How to apply for the qualification of overseas labor dispatch

You need to apply for registration at the local industrial and commercial bureau. After that, the Industrial and Commercial Bureau and the Human Resources and Social Security Bureau will organize an investigation of the enterprise, and you need to apply at the Exit-Entry Administration and the Foreign Trade and Economic Cooperation Bureau. Only after all the conditions are completed can you get the qualification. The labor contract signed between the dispatched personnel and the dispatching company shall not be less than 2 years. If the dispatched personnel go to the dispatched place without arrangement, the dispatching company shall pay twice the minimum living allowance for the dispatched personnel.

First, there are three main organizational forms of labor export in China:

1. State government departments arrange labor export in a planned and organized manner according to agreements signed with foreign governments;

2. Relevant companies and enterprises dispatch labor services for export according to labor service contracts signed with foreign companies or enterprises;

3. Individuals with labor export conditions export labor services by contacting relatives and friends abroad.

Labor dispatch refers to the fact that workers sign labor contracts with employers (also called labor dispatch units), but actually work for employers (also called units that accept employment in the form of labor dispatch). Its purpose is to reduce employment costs, avoid employment risks and facilitate employment management.

Two, China citizens to bid for the export of labor services should generally be through the following channels:

1. Apply for registration, training and dispatch through domestic enterprises specializing in labor export;

2, through the labor and personnel department of the location or unit;

3. Through personal friends and relatives overseas.

Legal basis: Article 3 of the Interim Provisions on Labor Dispatch stipulates that employers can only use dispatched workers in temporary, auxiliary or alternative jobs.

Temporary work mentioned in the preceding paragraph refers to work with working hours not exceeding 6 months; Auxiliary posts refer to non-main business posts that provide services for main business posts; Alternative work refers to the work that can be replaced by other workers in a certain period of time when the employees of the employer are unable to work due to full-time study, vacation and other reasons.

When the employer decides to use the auxiliary posts of the dispatched workers, it shall discuss with the workers' congress or all the workers, put forward plans and opinions, negotiate with the trade union or the workers' representatives on an equal footing, and publicize them in the employer.
