According to the Basic Law, laws enacted by the Legislative Council of the the NPC Standing Committee Special Administrative Region must be reported to the Standing Committee of the National People's Congress for the record. Filing does not affect the entry into force of the law. NPC cannot unilaterally and directly legislate on the internal management affairs of the Hong Kong Special Administrative Region. Because the Basic Law stipulates that the Hong Kong Special Administrative Region shall enjoy legislative power, the Legislative Council of the Special Administrative Region shall legislate in accordance with the legislative procedures stipulated in the Basic Law. The NPC Standing Committee (the Standing Committee of the National People's Congress) consulted its Committee on the Basic Law of the Hong Kong Special Administrative Region on the laws enacted by the Legislative Council of the Special Administrative Region and reported to the NPC Standing Committee for the record. If it is considered that the laws enacted by the legislature of the SAR do not conform to the provisions of the Basic Law concerning the affairs managed by the central authorities and the relationship between the central authorities and the Hong Kong Special Administrative Region, the relevant laws may be sent back without any amendment. The law sent back by the NPC Standing Committee is invalid immediately. Unless otherwise provided by the laws of the Hong Kong Special Administrative Region, the invalidation of this Law shall have no retrospective effect.
