Regulations of Zhejiang Province on the Promotion of Informatization

Chapter I General Provisions Article 1 In order to speed up the development of informatization, standardize informatization work, promote the integration of informatization and industrialization, and promote economic development and social progress, these Regulations are formulated in accordance with the provisions of relevant state laws and administrative regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to the informatization planning and construction, the development of information industry, the popularization and application of information technology, the development and utilization of information resources, information security and related management activities within the administrative area of this province. Article 3 Promoting the development of informatization should follow the principles of overall planning, resource sharing, being pragmatic and efficient, being based on innovation and ensuring safety. Article 4 The people's governments at or above the county level shall incorporate informatization construction into the national economic and social development plan, and establish and improve the leadership and coordination mechanism of informatization work.

The people's governments at or above the county level shall incorporate the funds needed for the informatization construction and operation and maintenance invested by the government into the fiscal budget at the corresponding level, increase the investment in informatization construction according to the financial resources, and guide and support the social funds to invest in informatization construction. Fifth people's governments at or above the county level shall be responsible for the planning, guidance, coordination, supervision and management of informatization development within their respective administrative areas.

Development and reform, communication management, radio and television, finance, urban and rural planning, public security, industrial and commercial administration, quality and technical supervision, science and technology, education, health, commerce, agriculture, meteorology, surveying and mapping, geographic information and other relevant departments shall, according to their respective functions and duties, do a good job in information development. Article 6 Encourage and support the cultivation and introduction of information research and information technology-related talents, and carry out research, development, popularization and application of information technology.

Popularize information technology education in primary and secondary schools, encourage the development of information technology vocational education, and encourage educational and training institutions to carry out information technology education and training.

Encourage organs, organizations, enterprises and institutions to strengthen the construction of information technology application ability and improve the management and service level. Chapter II Informatization Planning and Construction Management Article 7 The competent informatization department of the people's government at or above the county level shall, according to the national economic and social development plan of the administrative region and the informatization development plan at the next higher level, organize the compilation of the informatization development plan of the administrative region, report it to the people's government at the same level for approval and implementation according to the prescribed procedures, and report it to the competent informatization department at the next higher level for the record.

The special plan for the informatization development of this department (system) compiled by other relevant departments of the people's government at or above the county level shall conform to the informatization development plan of this administrative region and be reported to the competent information department at the same level for the record.

The preparation of informatization development planning and informatization development special planning shall organize experts to demonstrate and solicit opinions extensively. Article 8 The competent department of urban and rural planning and the departments of communication management, radio and television of the people's governments of cities and counties shall, according to the overall urban planning, the overall planning of counties (cities) and the information development planning, prepare special plans for the construction of public information infrastructure such as telecommunication networks, radio and television networks and the Internet in the local area, and report them to the people's governments at the corresponding levels for approval before implementation.

The construction of public information infrastructure such as telecommunication network, radio and television network and Internet should adhere to the principles of urban and rural planning, unified standards and resource sharing, and implement intensive construction and management.

The people's governments at or above the county level and relevant departments shall, in accordance with state regulations, actively promote the integration of telecommunication networks, radio and television networks and the Internet in business, networks and terminals. Article 9 The competent department of informatization of the people's government at or above the county level shall timely announce the informatization development plan and its implementation through public media, provide consulting services for the public and accept social supervision.

No unit or individual may change the approved information development plan and the special plan for the construction of public information infrastructure without authorization; If it is really necessary to change, it shall be submitted for approval in accordance with the original examination and approval procedures. Tenth information construction should strictly implement the national and industry mandatory standards and local standards and norms of information construction in this province.

The local standards and norms of informatization construction in this province are formulated and supervised by quality and technical supervision, informatization and other relevant departments. Eleventh new construction, renovation and expansion of telecommunications networks, radio and television networks, the Internet and other public information infrastructure, should meet the requirements of information development planning and public information infrastructure construction special planning.

According to the requirements of the special planning for the construction of public information infrastructure, land units, management units, residential quarters and collective economic organizations should provide convenience if public information infrastructure needs to be set up within the scope of land used by organs, social organizations, enterprises and institutions, or within the scope of land used by infrastructure, public welfare undertakings and residential quarters, or within the scope of collectively owned land.

When setting up public information infrastructure, we should do a good job in wind resistance, earthquake prevention and lightning protection of the facilities to avoid adverse effects on traffic and landscape.

The establishment of public information infrastructure shall go through the examination and approval procedures for urban and rural planning, land use and environmental protection according to law. Twelfth government investment in new construction, renovation and expansion of information construction projects, the investment department in charge of the project approval, should seek the opinions of the information department at the same level in advance.

The competent department of informatization shall organize a review of the demand and benefit, planning and layout, technical standards, network and information security, information resources and other related contents of informatization construction projects, and issue a written review opinion. If the investment department refuses to adopt the opinions put forward by the information department, it shall explain the reasons.

If the information construction project specified in the first paragraph of this article does not meet the relevant planning requirements, the competent investment department shall not approve it.
