Medical service contract

A medical service contract refers to a contract in which one party provides medical services and the other party accepts medical services and pays medical expenses. The party providing medical services is usually a medical institution or medical staff, which we call a doctor; The party receiving medical services is the patient, which is called the patient here.

Legal basis: Article 470th of the Civil Code of People's Republic of China (PRC). The contents of the contract shall be agreed by the parties, and generally include the following clauses:

(1) The name and domicile of the party concerned;

(2) Subject matter;

(3) quantity;

(4) quality;

(5) Price or remuneration;

(6) Time limit, place and method of performance;

(7) Liability for breach of contract;

(8) Methods for resolving disputes.

The parties may conclude a contract by referring to the model texts of various contracts.
