Article 1 In order to strengthen the selection management of government procurement experts and standardize the selection behavior, these Rules are formulated in accordance with the People's Republic of China (PRC) Government Procurement Law and its implementing regulations, the Measures for the Administration of Government Procurement Experts of the Ministry of Finance (Caiku [20 16] 198) and other laws, regulations and relevant regulations, and in combination with the actual situation.
Article 2 These Rules are applicable to the selection and management of Hebei provincial government procurement evaluation experts (hereinafter referred to as evaluation experts).
Article 3 The bid evaluation expert database shall be managed dynamically and uniformly by the Provincial Department of Finance, and the regions shall be divided according to districts and cities, and the original city and county (district) bid evaluation expert database shall be abolished at the same time.
Article 4 Cities and counties (districts) randomly select bid evaluation experts from the provincial bid evaluation expert database through the Hebei provincial government procurement bid evaluation expert management system. The cities and counties (districts) that set up public resource trading centers should set up expert selection points in public resource trading centers; Without the establishment of a public resource trading center, a bid evaluation expert database should be set up in the financial department at the same level.
Article 5 The purchaser and procurement agency shall select and determine the corresponding bid evaluation specialty from the provincial bid evaluation expert database according to the procurement contents and projects.
Article 6 Buyers and procurement agencies shall select bid evaluation experts who meet the requirements of laws and regulations according to the procurement methods and project requirements.
Article 7 The purchaser and the procurement agency shall select the selected area of experts according to the budget of the procurement project. Single or batch (including contract package) procurement budget is less than 5 million yuan, which can be drawn within the scope of its districts and cities; 5 million yuan and above, less than 6.5438+million yuan, drawn in at least 2 districts and cities; 100000 yuan and above, less than 50 million yuan, drawn in at least 3 districts and cities; 50 million yuan and above, should be set aside in the province. Projects with great social impact, complex technology or special procurement needs can be hired in the province, or experts can be hired outside the province as needed.
Article 8 A purchaser and a procurement agency shall select experts for evaluation. Those selected within the scope of this district and city shall be selected on the day of evaluation activities, and cross-regional selection shall not be earlier than 48 hours before evaluation activities in principle.
Article 9 A purchaser and a procurement agency shall, under the on-site supervision of the staff of a public resource trading center (a county without a public resource trading center is in the financial department at the same level), select bid evaluation experts in accordance with regulations.
Article 10 The purchaser and the procurement agency shall designate foreseeable experts who participated in the project consultation and demonstration in the early stage, recommended suppliers and avoided the evaluation, and record them in the evaluation expert management system. The purchaser and the procurement agency shall not expand the scope of avoidance without reason.
Article 11 If the number of relevant experts in this city's bid evaluation expert database can't meet the needs of random sampling, the purchaser and procurement agency shall adjust and increase the majors with high correlation or adjust and expand the sampling area to continue random sampling; If it still can't meet the needs of random sampling, the purchaser and the procurement agency can recommend qualified personnel to be randomly selected for use after examination.
Article 12 If the technology is complex, the professional requirements are high, the country has special requirements or it belongs to a new field, and it is difficult for the provincial expert database to meet the needs, with the consent of the competent budget unit, the purchaser may select bid evaluation experts in the corresponding professional field.
Thirteenth due to the absence or avoidance of experts, the number of experts on the spot does not meet the requirements, the purchaser and the procurement agency shall promptly supplement the experts. If the bid evaluation experts cannot be replenished in time, the purchaser and the procurement agency shall immediately stop the bid evaluation, properly keep the procurement documents, and re-establish the bid evaluation committee, negotiation team, inquiry team and consultation team at any time to conduct bid evaluation.
Article 14 The list of bid evaluation experts shall be kept confidential before the announcement of the bid evaluation results. The purchaser and procurement agency shall publish the list of bid evaluation experts together with the bid winning and transaction results, and indicate the bid evaluation experts selected by themselves.
Fifteenth centralized procurement of items in the catalogue, by the centralized procurement agencies to pay expert remuneration; For projects outside the centralized procurement catalogue, the purchaser shall pay the labor remuneration of the bid evaluation experts. If the bid evaluation experts participate in the bid evaluation in different places, their travel expenses shall be reimbursed by the purchaser or centralized procurement institution.
Sixteenth review service fee standards, evaluation of accommodation fees and transportation subsidies in different places.
(a) review the standard of expert service fees. To participate in the review of this Municipality, the review time shall be paid according to the standard of 300 yuan within 2 hours; Participate in the off-site review, and pay the fee according to the 400 yuan standard within 2 hours; If it exceeds 2 hours, it shall be calculated according to the standard of exceeding 1 hour 100 yuan. More than half an hour is less than 1 hour, calculated as 1 hour; Less than half an hour does not count. If the evaluation experts are late for more than 30 minutes, the labor fee will be deducted 100 yuan. The bid evaluation experts have arrived at the bid evaluation site, but have not yet entered the bid evaluation stage, and have declared the bid invalid and paid the lost time fee 100 yuan. If the bid evaluation experts find that they should avoid it after arriving at the bid evaluation site, they shall pay the lost time fee 100 yuan.
(2) Evaluation of off-site accommodation fees. According to the Notice of Hebei Provincial Department of Finance on Adjusting the Travel and Accommodation Standards of Provincial Organs (15).
(3) Evaluation of transportation subsidies in different places. With the current valid public transportation (including bus, subway, coach, train and air ticket) vouchers, the return transportation will be paid according to the same amount of expenses actually incurred on the way. Self-driving is reimbursed with the receipt of high-speed toll (the return trip is paid according to the same amount of expenses actually incurred on the way). If you don't have a receipt for high-speed charges, you won't pay it. The gasoline fee is calculated per kilometer 1 yuan, and the kilometers are calculated from the city to the evaluation site.
Seventeenth bid evaluation experts leave the bid evaluation site without completing the bid evaluation work, or commit illegal acts in the bid evaluation activities, and shall not receive labor remuneration and reimbursement of bid evaluation travel expenses in different places. Personnel other than bid evaluation experts shall not receive remuneration for bid evaluation services.
Eighteenth selected experts are all recorded in the log of the bid evaluation expert database, and the whole process leaves traces as supervision and inspection materials.
Nineteenth financial departments, purchasers and procurement agencies shall complete the expert review and deduct points within the specified time. The Provincial Department of Finance sets the ladder extraction probability according to the evaluation of the deduction points by the evaluation experts.
Twentieth financial departments, purchasers and procurement agencies are prohibited from engaging in the following activities in the bid evaluation expert management system:
(a) using the evaluation expert database to extract evaluation experts from non-government procurement projects and virtual projects;
(two) the disclosure of personal information of experts;
(3) Input false information.
Twenty-first buyers, procurement agencies in violation of these rules, in accordance with the "Government Procurement Law" and relevant laws and regulations shall be investigated for corresponding responsibilities; Whether the staff of the financial department have abused their powers, neglected their duties, engaged in malpractices for selfish ends and other illegal acts. In accordance with the relevant provisions of the Government Procurement Law and its implementing regulations, the Civil Service Law and the Administrative Supervision Law, the corresponding responsibilities shall be investigated. Those suspected of committing a crime shall be transferred to judicial organs for handling.
Article 22 If the previous system and measures are inconsistent with these Rules, these Rules shall prevail.
Twenty-third these rules shall be interpreted by the Hebei Provincial Department of Finance.
Article 24 These Rules shall come into force on July 1 day, 2065438, and shall be valid for five years.
