Drug addicts should receive drug treatment.
Article 28 The identification of drug addiction shall be carried out by the public security organ or the drug rehabilitation medical institution entrusted by it in accordance with the relevant provisions of the state, and the administrative department of health shall give necessary guidance and assistance.
Article 29 Drug addicts are encouraged to give up drug addiction. Drug addicts can go to drug rehabilitation medical institutions to receive drug rehabilitation treatment.
Drug rehabilitation medical institutions shall sign a voluntary drug rehabilitation agreement with voluntary drug addicts or their guardians, and report the names, types and numbers of identity documents of drug addicts and the drug rehabilitation period to the county (city, district) and the municipal public security organ within three days from the date of signing the agreement.
Thirtieth county (city, district) people's government shall, in accordance with the relevant provisions of the province, set up more than one medical institution for drug rehabilitation or determine more than one medical institution as a medical institution for drug rehabilitation. Medical institutions for drug rehabilitation shall abide by the relevant national standards for drug rehabilitation treatment.
The health administrative department at or above the county level shall, jointly with the public security organ and the judicial administrative department, make use of the existing medical and health resources, strengthen the construction of drug rehabilitation medical institutions, and provide drug rehabilitation medical services such as outpatient treatment, hospitalization treatment, drug maintenance treatment and psychological consultation for drug addicts.
Article 31 The county (city, district) and municipal public health administrative departments shall, jointly with the public security organs and the food and drug supervision and administration departments, rationally arrange and scientifically set up drug maintenance treatment clinics and drug abuse points in accordance with the relevant provisions of the state and the province, so as to facilitate drug addicts to receive treatment nearby and ensure the continuity and stability of treatment.
Thirty-second drug addicts, the public security organs can order them to accept community drug rehabilitation. Community drug rehabilitation work by the township (town) people's government, street offices responsible for the implementation.
The family members of drug addicts and the units where drug addicts seek medical treatment, employment and schooling shall cooperate with the township (town) people's government, street offices and their designated grassroots organizations to carry out community drug rehabilitation work and help drug addicts get rid of drugs.
Thirty-third township (town) people's governments and neighborhood offices shall, according to the needs of work and the relevant provisions of the province, be equipped with full-time community drug addicts, formulate community drug rehabilitation work plans, and implement community drug rehabilitation measures.
Full-time community drug addicts are recruited by the people's governments at or above the county level; Its training, specific responsibilities and management measures are formulated by the provincial public security, finance, civil affairs, human resources and social security departments in accordance with the relevant provisions of the state and the province.
Thirty-fourth township (town) people's governments and sub-district offices shall, after receiving the report, sign a community drug rehabilitation agreement with community drug addicts in a timely manner. The community drug rehabilitation agreement shall include the following contents:
(a) the rights enjoyed by drug addicts and the help they can get;
(two) the provisions that drug addicts should abide by;
(3) Specific measures for community drug rehabilitation;
(four) the legal consequences of violating the community drug rehabilitation agreement;
(5) Other matters that should be clarified.
Thirty-fifth drug addicts have one of the circumstances listed in the first paragraph of Article 38 of the Anti-drug Law of People's Republic of China (PRC), and the public security organs of the county (city, district) and city where the illegal act occurred shall make a decision of compulsory isolation for drug rehabilitation.
The living expenses and medical expenses of drug addicts during compulsory isolation and detoxification shall be implemented in accordance with the relevant provisions of the state and the province.
Article 36 The public security organ that has made a decision on compulsory isolation for drug rehabilitation may order the drug addicts who have been released from compulsory isolation to receive community rehabilitation, and issue a decision on community rehabilitation, which shall be served on them and their families, and notify the township (town) people's government and the subdistrict office that have implemented community rehabilitation.
Article 37 Community drug addicts and community rehabilitation personnel shall report to the township (town) people's government and subdistrict offices that implement community drug rehabilitation and community rehabilitation within two days from the date of receiving the decision to order community drug rehabilitation and community rehabilitation, and sign an agreement on community drug rehabilitation and community rehabilitation; If the journey is long and the traffic is inconvenient, you should report for duty within fifteen days at the latest.
Community drug addicts and community rehabilitation personnel who change the execution place shall report to the changed township (town) people's government and sub-district office within two days from the date of receiving the notice of changing the execution place; If the journey is long and the traffic is inconvenient, you should report for duty within fifteen days at the latest.
Article 38 If a person ordered to accept community rehabilitation refuses to accept community rehabilitation or seriously violates the community rehabilitation agreement, the public security organ may order him to accept community detoxification.
Thirty-ninth voluntary drug addicts, community drug addicts and community rehabilitation workers can go to drug rehabilitation places for drug rehabilitation; Drug addicts shall abide by the relevant provisions of drug rehabilitation places.
Drug rehabilitation places should have basic functions such as life service, rehabilitation treatment, vocational training and artistic labor, establish and improve the management system of drug rehabilitation, and prohibit the inflow of drugs.
Article 40 Full-time community drug addicts, community policemen, villagers' committees, residents' committees' anti-drug workstations or anti-drug liaison officers should strengthen their contact with drug addicts and their families, work units and schools, regularly understand their life, ideological status and social interaction, help and educate them to stay away from drugs and prevent them from taking drugs again.
Forty-first people's governments at or above the county level shall encourage and support social organizations, enterprises and institutions, other organizations and individuals to participate in social services for drug rehabilitation.
People's governments at all levels and their relevant departments should strengthen vocational skills training and employment guidance for drug addicts, provide employment information, broaden employment channels, encourage and support drug addicts to find jobs and start businesses, and help them return to society.
Units that employ drug addicts with employment difficulties, sign labor contracts for more than one year and pay social insurance premiums enjoy preferential policies such as national and provincial social insurance subsidies and public welfare post subsidies.
Forty-second people's governments at or above the county level and their relevant departments shall incorporate drug rehabilitation projects into the public health and medical security system. The medical expenses of drug addicts during voluntary detoxification, community detoxification and community rehabilitation shall be included in the basic medical insurance for urban workers, medical insurance for urban residents and the new rural cooperative medical system in accordance with the relevant provisions of the province.
Forty-third drug addicts who are forced to be isolated or ordered to give up drugs in the community may not apply for a motor vehicle driver's license during the period of drug rehabilitation; If the physical condition is not suitable for driving a motor vehicle, the motor vehicle driving license obtained by him shall be cancelled according to law.
Persons who are subject to administrative punishment or compulsory isolation for drug abuse and ordered to accept community drug rehabilitation shall provide drug abuse test reports if they apply for and examine motor vehicle driving licenses within one year after the execution of administrative punishment or the termination of drug rehabilitation.
