Measures for Shaanxi Province to Implement the Law of People's Republic of China (PRC) on the Prevention of Juvenile Delinquency

Article 1 In order to implement the Law of People's Republic of China (PRC) on the Prevention of Juvenile Delinquency, these Measures are formulated in light of the actual situation of this province. Article 2 The prevention of juvenile delinquency shall be governed by comprehensive measures under the leadership of people's governments at all levels. People's governments at all levels shall set up a leading and coordinating body to determine a person in charge, and the office shall be located in the Communist Youth League Committee at the same level.

Public security, education, culture, press and publication, radio and television movies, labor and social security, industrial and commercial administration, civil affairs, judicial administration, information industry and other relevant departments, comprehensive management offices at all levels and judicial organs are responsible for the prevention of juvenile delinquency within their respective functions and duties.

* * * The Communist Youth League, women's federations and other relevant social organizations assist in relevant work. Article 3 The main duties of people's governments at all levels in preventing juvenile delinquency are:

(a) to organize the formulation of five-year plans and annual work plans for the prevention of juvenile delinquency;

(2) Organizing and coordinating activities to prevent juvenile delinquency;

(three) to organize the investigation and study of juvenile delinquency and prevention, and put forward countermeasures;

(four) to check the implementation of the "People's Republic of China (PRC) Law on the Prevention of Juvenile Delinquency" and these measures and work plans;

(five) to organize the publicity of laws, regulations and policies for the protection and prevention of juvenile delinquency;

(six) summarize and popularize the experience of preventing juvenile delinquency, and establish and commend advanced models. Article 4 People's governments at all levels shall include funds for the prevention of juvenile delinquency in their fiscal budgets at the corresponding levels. Article 5 Parents or other guardians of minors shall perform the following obligations:

(a) to educate minors in terms of law-abiding, civilized and polite, honest and trustworthy, and self-care;

(2) When minors have psychological barriers or bad behaviors, they should take the initiative to seek help from schools and relevant parties and strive to eliminate the psychological barriers or bad behaviors of minors;

(three) take the initiative to contact the school, cooperate with the school's educational activities, and strengthen the cultivation of ideological and moral quality and civilized behavior of minors.

Parents of minors shall not fail to fulfill their obligations of educating their children because of divorce. Article 6 Schools shall perform the following duties in the education of juvenile delinquency prevention:

(a) the legal education into the school teaching plan and organize the implementation, cultivate the legal awareness of minors;

(two) equipped with full-time or part-time teachers engaged in legal education, according to the actual needs to hire off-campus legal counselors;

(three) to carry out extracurricular activities suitable for minors' physical and mental development characteristics, and to cultivate minors' sound personality and good conduct;

(four) establish and improve the system of home visits, close contact with parents, and strengthen family education guidance;

(five) regularly check the effectiveness of juvenile crime prevention education;

(six) other work related to the prevention of juvenile delinquency. Article 7 Schools shall respect and protect minors' right to education, and shall not expel or order them to drop out of school or transfer. We should patiently educate and help minors who have bad behaviors, and we should not discriminate or let them go. Article 8 Education administrative departments at all levels shall establish campus network centers, and schools shall gradually establish campus networks to guide minors to surf the Internet healthily. Article 9 Schools, parents or other guardians of minors shall provide targeted physical and psychological education to minors.

Schools should set up special psychological counseling institutions or be equipped with psychological counseling teachers to provide psychological counseling for minors in school. Tenth education administrative departments at or above the county level shall expand the enrollment scale of secondary vocational schools and absorb minors who have completed compulsory education to receive vocational education.

The administrative department of labor and social security at or above the county level shall establish and improve the vocational skills training system, and carry out labor skills training and crime prevention education for minors who have completed compulsory education but have not continued their studies in a planned way. Eleventh residents' committees and villagers' committees shall cooperate with schools and relevant departments to prevent juvenile delinquency, with families, schools and public security organs to help educate minors with bad behavior, and with families unable to discipline their minor children.

Residents' committees and villagers' committees may employ volunteers who are enthusiastic about the education of minors to assist in the education and management of minors. Twelfth people's governments at or above the county level shall strengthen the planning, construction and management of juvenile palaces, children's activity centers and other places for minors' activities. Every county (city, district) must have at least one comprehensive activity place for minors outside school. Thirteenth relevant departments of the people's government, judicial organs, the Communist Youth League, women's federations and relevant social organizations shall, according to the actual situation, organize and carry out various forms of publicity and education activities to prevent juvenile delinquency. Fourteenth news publishing, radio and television movies, culture, information industry and other administrative departments should take measures to encourage and support the creation, production and publication of books, periodicals, audio-visual products and electronic publications that are beneficial to the physical and mental health of minors.

Radio, television, movies, plays, advertisements, books and periodicals, audio-visual products and electronic publications shall not contain contents that induce minors to commit crimes and exaggerate violence, pornography, gambling, terrorist activities and other activities that endanger minors' physical and mental health. When reporting criminal cases, the news media shall not exaggerate the details and means of crime.

No unit or individual may sell or rent books, periodicals, audio-visual products and electronic publications that contain the contents that endanger the physical and mental health of minors as stipulated in the preceding paragraph, or provide information that contains the contents that endanger the physical and mental health of minors as stipulated in the preceding paragraph by means of communication or computer network.
