Regulations of Shenzhen Special Economic Zone on Informatization Construction (revised on 20 19)

Chapter I General Provisions Article 1 In order to promote the development of informatization construction in Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone) and strengthen the planning and management of informatization construction, these Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the actual conditions of the Special Zone. Article 2 These Regulations shall apply to the compilation of the informatization construction plan of the Special Zone, the formulation of policies for the development of the information industry, the construction of information networks and information application systems, and the development and utilization of information resources. Article 3 The informatization construction shall follow the principles of overall planning, interconnection and resource sharing.

Informatization construction should be incorporated into the city's national economic and social development plan, and pay attention to social and economic benefits. Article 4 The Municipal People's Government shall support the development of the information industry, carry out information popularization education and publicity in a planned and step-by-step manner, and raise the information awareness of the whole people. Article 5 The municipal competent department of industry and informatization is responsible for the planning, management, coordination and supervision of informatization construction.

The municipal government service data management department and the municipal public security and market supervision departments shall do a good job in informatization within their respective responsibilities. Chapter II Planning of Informatization Construction Article 6 The overall planning of informatization construction in this Municipality shall be formulated by the municipal competent department of industry and informatization, and implemented after being approved by the Municipal People's Government. If it is to be reported to the state for approval, it will be implemented after the state approves it.

After the overall planning of informatization construction in this Municipality takes effect, no organization or individual may modify or change it without authorization. If it is really necessary to make corresponding adjustments, it shall be submitted for approval in accordance with the procedures stipulated in these regulations. Article 7 The preparation of the overall plan for informatization construction in this Municipality shall conform to the requirements of the national informatization construction plan and the national economic and social development plan of this Municipality.

The preparation of the overall planning of the city's informatization construction should also solicit the opinions of all relevant departments and all sectors of society, and organize experts to demonstrate. Eighth municipal departments and district people's governments shall, according to the requirements of the overall planning of informatization construction in this Municipality, formulate special plans and district informatization plans, and report them to the municipal competent department of industry and informatization for review. Article 9 The municipal competent department of industry and informatization shall announce the overall planning of informatization construction and its implementation, and accept the consultation and supervision from all walks of life. Chapter III Information Industry Article 10 The information industry mentioned in these Regulations includes electronic information product manufacturing, software industry, communication industry and related information service industry. Article 11 The municipal competent department of industry and information technology shall, jointly with relevant departments, compile a catalogue of the development of the municipal information industry to guide the development of the information industry. Article 12 The municipal and district people's governments shall arrange a certain proportion of funds to support the development of the information industry when preparing the annual financial budget.

The Municipal People's Government shall establish a risk investment mechanism for the information industry and encourage domestic and foreign enterprises, other economic organizations and individuals to invest in the information industry. Unless otherwise stipulated by the state, such provisions shall prevail. Article 13 The Municipal People's Government shall formulate specific preferential policies and measures for the manufacture of electronic information products, the development and promotion of software, and the development and utilization of information resources, and encourage the development and production of advanced information technologies and information products at home and abroad. Fourteenth enterprises engaged in electronic information product manufacturing and software development should strictly implement the mandatory standards stipulated by the state, industry and local governments. If there is no mandatory standard, encourage the adoption of international advanced standards. Fifteenth Municipal People's Government shall strengthen the standardized management of the information service industry, ensure fair competition, and safeguard the interests of the state and users. Chapter IV Information Engineering Article 16 Information engineering as mentioned in these Regulations refers to information network, information application system construction, information resource development and other projects with computer technology and communication technology as the main means. Seventeenth information engineering projects invested by the Municipal People's government shall be examined and approved by the municipal development and reform department, and the government service data management department of the municipal government shall be responsible for assisting the examination and approval and acceptance supervision of e-government projects; Non-government investment in information engineering projects, the construction unit shall report the relevant feasibility study report, design, construction and quality supervision plan to the municipal competent department of industry and information technology for the record.

The municipal competent department of industry and informatization, the service data management department of the municipal government, and the municipal development and reform department shall, according to the requirements of the national informatization construction plan and the overall planning of the municipal informatization construction, review the informatization project to avoid redundant construction and industry monopoly. Eighteenth information engineering design, construction units should strictly implement the mandatory standards stipulated by the state, industry and local, to ensure that the information network and application system can be interconnected. If there is no mandatory standard, encourage the adoption of international advanced standards.

The municipal competent department of industry and information technology shall, jointly with the municipal market supervision department, compile the catalogue and index of information engineering standards and publish them. Nineteenth city industry and information technology, government service data management departments and other relevant departments shall formulate specific measures for quality supervision of information engineering, and gradually establish and improve the bidding system, supervision system and completion acceptance system of information engineering. Chapter V Information Resources Article 20 Municipal and district state organs shall, according to their respective functions and duties, develop and establish corresponding databases and application systems to realize interconnection and office automation.

All information resources that can be made public, such as the establishment of government agencies, division of responsibilities, procedures, conditions and basis, shall be announced to the public through public information networks or other media.

The public information network mentioned in the preceding paragraph refers to various communication networks and computer networks that provide services to the public, such as telecommunication networks, cable TV networks, satellite communication networks and wireless communication networks.
