Legal analysis: there are risks. Disputes arise in the course of business operation. For example, if you are the operator of the business license of self-employed, then you are the main person in charge. Self-employed is not a limited liability company, and self-employed bears unlimited liability. If you need compensation because of a dispute, you need personal compensation to the end. One of the most serious consequences is to bear certain legal responsibilities. According to China's current laws and regulations, when an economic dispute occurs, the individual operators bear unlimited joint liability, that is, in whose name to apply for the business license of individual industrial and commercial households, and who is responsible for paying off and returning the debts, including all the family property.
Legal basis: Interpretation of the Supreme People's Court on the Application of the Civil Procedure Law of People's Republic of China (PRC) Article 59 In litigation, individual industrial and commercial households take the business operators registered in their business licenses as the parties. If there is a name, the name registered in the business license shall be the party concerned, but the basic information of the operator of the name shall be indicated at the same time. If the business operator registered in the business license is inconsistent with the actual operator, the registered operator and the actual operator are the same party.
