Regulations of Huizhou Municipality on the Protection of Historical and Cultural Cities

Chapter I General Provisions Article 1 In order to strengthen the protection and management of famous historical and cultural cities in this Municipality, and to inherit and carry forward excellent historical culture, these Regulations are formulated in accordance with the People's Republic of China (PRC) Urban and Rural Planning Law, the People's Republic of China (PRC) Cultural Relics Protection Law, the Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection, management and utilization of historical urban areas, historical and cultural blocks, historical buildings, ancient and famous trees, traditional place names, cultural relics and intangible cultural heritage within the administrative area of this Municipality.

Where laws and regulations have other provisions on the protection of ancient and famous trees, traditional place names, cultural relics and intangible cultural heritage, those provisions shall prevail. Article 3 The protection of famous historical and cultural cities should follow the principles of scientific planning, strict protection, classified management and rational utilization, correctly handle the relationship between economic and social development and the protection of historical and cultural heritage, maintain and continue the traditional pattern and historical features of famous historical and cultural cities, safeguard the authenticity and integrity of historical and cultural heritage, and inherit, excavate and carry forward local excellent historical culture. Fourth people's governments at or above the county level shall be responsible for the protection, supervision and management of historical and cultural cities within their respective administrative areas.

Township people's governments and sub-district offices are responsible for carrying out daily inspections and on-site protection of historical and cultural cities within their respective jurisdictions.

People's governments at all levels can carry out the protection of historical and cultural cities by purchasing services from social forces. Article 5 The competent department of urban and rural planning shall be responsible for organizing the preparation of protection plans, the general survey and maintenance of historical and cultural blocks and historical buildings, and jointly organizing the implementation of these Regulations with the competent department of cultural relics.

The competent department of cultural relics shall be responsible for the protection, supervision and management of historical and cultural cities as stipulated by laws and regulations and these regulations.

The competent department of city management is responsible for the supervision and inspection of the planning, construction and other illegal acts in the protection of historical and cultural cities, and exercises the right of administrative punishment in accordance with the provisions of laws and regulations and these regulations.

The relevant departments in charge of development and reform, education, ethnic religion, public security, fire protection, civil affairs, finance, land and resources, forestry, tourism, public utilities, gardens, real estate, sanitation, etc. shall do a good job in the specific supervision and management of the protection of historical and cultural cities within their respective functions and duties. Article 6 The Municipal People's Government shall establish a historical and cultural city protection committee and a historical and cultural city expert database. The people's governments at the county level shall, according to the specific conditions and actual needs of their respective administrative regions, set up a historical and cultural city protection committee and a historical and cultural city expert database.

The Committee for the Protection of Historical and Cultural Cities is responsible for coordinating the protection of historical and cultural cities within their respective administrative areas, coordinating and handling major issues and emergencies in the protection of historical and cultural cities, and supervising and inspecting relevant parties to implement the responsibility for the protection of historical and cultural cities.

The expert database of historical and cultural cities is composed of experts in the fields of planning, architecture, culture, cultural relics, history, land, fire protection, society, economy and law. Experts in historical and cultural cities are responsible for demonstrating or reviewing major issues and major policies and measures for the protection of historical and cultural cities, and providing advice. Article 7 The people's governments at or above the county level shall incorporate the protection, supervision and management of historical and cultural cities into the national economic and social development plan, include the funds for the protection of historical and cultural cities in the fiscal budget at the corresponding level, and set up special funds for the protection of historical and cultural cities.

Special funds for the protection of historical and cultural cities are used for the investigation of protected objects, the formulation of protection lists, the preparation of protection plans, maintenance and repair subsidies, commendation and awards, academic research, publicity and education, etc. Eighth any unit or individual has the right to put forward opinions and suggestions on the protection of historical and cultural cities, and report the acts of destroying historical and cultural cities.

Encourage enterprises, institutions, social organizations and individuals to participate in the protection of historical and cultural cities through the establishment of social funds, donations and volunteer activities.

Units and individuals that have made outstanding contributions to the protection of historical and cultural cities shall be commended and rewarded by the people's governments at or above the county level. Article 9 The people's governments at or above the county level shall strengthen the research, publicity and education on the protection of historical and cultural cities, carry forward the excellent local history and culture by organizing traditional culture research, publication, training, exhibition and media publicity, and enhance the awareness of the whole society on the protection of historical and cultural cities.

The competent education department shall incorporate local historical and cultural knowledge into the extracurricular education content of students in school, and promote the inheritance of local excellent historical and cultural. Tenth people's governments at or above the county level shall regularly inspect and evaluate the protection of historical and cultural cities, and report the protection of historical and cultural cities to the Standing Committee of the people's congress at the corresponding level.

The Standing Committee of the people's congress at or above the county level shall strengthen the supervision and inspection of the protection of historical and cultural cities of the people's government at the same level by organizing law enforcement inspections, listening to and deliberating special work reports, etc. Chapter II Protection List and Protection Planning Article 11 The people's governments at or above the county level shall establish a protection list of historical and cultural cities, and include the following protected objects in the protection list:

(1) Historical cities, historical and cultural blocks and historical buildings;

(2) Old and famous trees;

(3) traditional place names;

(4) immovable cultural relics;

(5) Intangible cultural heritage;

(six) other protected objects as prescribed by laws and regulations.

The Municipal People's Government shall establish an information management system for historical and cultural cities, and incorporate the protection list of historical and cultural cities into the unified management of the information management system. The protection list of historical and cultural cities shall be made public.
