Regulations of Ningxia Hui Autonomous Region on Green Building Development (202 1 Revision)

Chapter I General Provisions Article 1 In order to promote the development of green buildings, save resources and improve the quality of human settlements, these Regulations are formulated in accordance with the provisions of the Building Law of People's Republic of China (PRC), the Energy Conservation Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of the autonomous region. Article 2 These Regulations shall apply to the planning, design, construction, operation, transformation, evaluation, supervision and management related to green buildings within the administrative area of the autonomous region. Article 3 The term "green building" as mentioned in these Regulations refers to a civil building that saves resources, protects the environment and reduces pollution to the maximum extent, provides people with healthy, applicable and efficient use space, and is in harmony with nature. Fourth people's governments at or above the county level shall incorporate the development of green buildings into the national economic and social development plan, establish and improve the working mechanism and target responsibility assessment system for the development of green buildings, and promote the development of green buildings. Fifth people's governments at or above the county level shall be responsible for the supervision and management of green building activities within their respective administrative areas.

The relevant departments of the people's governments at or above the county level, such as development and reform, industry and informatization, finance, natural resources, ecological environment, science and technology, water conservancy, statistics, and government affairs management, shall, according to their respective functions and duties, do a good job in the development of green buildings. Article 6 People's governments at or above the county level shall formulate policies and measures to promote the development of green buildings, encourage and support the research, development, demonstration, popularization and publicity of green building technologies, and promote the progress and innovation of green building technologies.

The people's governments at or above the county level shall commend and reward the units and individuals that have made remarkable achievements in green building work. Chapter II Planning and Construction Article 7 The overall urban planning shall adhere to the principle of green development and implement the requirements of ecological environment protection, comprehensive utilization of energy, comprehensive utilization of water resources, economical and intensive utilization of land and comprehensive utilization of solid waste.

The competent construction department of the people's government at or above the county level shall, jointly with the relevant departments, organize the preparation of the special plan for green buildings in this administrative region, and report it to the people's government at the corresponding level for approval before implementation. Article 8 When compiling the regulatory detailed planning of the town where the people's government of a city or county is located, the technical indicators such as the proportion of green buildings, the proportion of prefabricated buildings, the proportion of new wall materials and the proportion of green building materials shall be determined in combination with the characteristics of surrounding buildings. Article 9 According to the technical application level and evaluation requirements, green buildings are divided into three grades: one star, two stars and three stars from low to high.

New civil buildings within the scope of construction land determined by the overall urban planning shall be planned, designed and built in accordance with the green building standards of one star or above.

Large public buildings invested by state-owned funds or financed by the state shall be planned, designed and constructed in accordance with the green building standards of two or more stars. Encourage other buildings to build in accordance with the green building standards of two or more stars. Tenth construction project feasibility study report or project application report shall include the requirements of green building grade, and specify the green building technology, investment, energy saving and emission reduction benefits selected by the project.

The investment department of the people's government at or above the county level shall, when establishing a construction project, incorporate the green building grade and related technical indicators into the scope of energy-saving evaluation and review of fixed assets investment projects. Eleventh urban and rural planning departments of the people's governments at or above the county level shall, according to the requirements of regulatory detailed planning, define the green building grade and related technical indicators in the planning conditions of construction land. Article 12 Where the competent department of natural resources of the people's government at or above the county level transfers, leases or allocates land for civil construction, it shall incorporate the green building grade and related technical indicators determined by the planning conditions for construction land into the contract for transferring the right to use state-owned construction land or the decision on allocating state-owned construction land. Thirteenth construction units in the project consultation, design, construction, inspection and testing, it should be clear about the green building level, assembly rate of prefabricated buildings and other indicators, and may not express or imply that the entrusted unit reduces the green building indicators. Fourteenth design units shall design in accordance with the relevant mandatory standards for green buildings, and the design documents shall include special articles on green building design.

The construction drawing review institution shall review the green building design content in the construction drawing design documents, and indicate whether it meets the relevant mandatory standards for green buildings in the review opinions.

The construction unit shall prepare and implement a green construction plan, and take energy-saving and emission-reduction and environmental protection measures such as reducing energy consumption, water consumption and pollutant discharge during the construction process. The construction unit shall inspect the building materials, building components, facilities and equipment on the construction site, and shall not use them if they do not meet the requirements of the construction drawing design documents.

The supervision unit shall, according to the construction drawing design documents and the relevant mandatory standards for green buildings, prepare the supervision plan for green buildings and organize its implementation. Fifteenth construction units should incorporate the mandatory standards related to green buildings into the project completion acceptance. Those who do not meet the relevant mandatory standards for green buildings shall not pass the final acceptance.

If the construction unit fails to accept the relevant mandatory standards for green buildings, the competent construction department of the people's government at or above the county level shall order it to reorganize the acceptance. Article 16 The construction unit shall publicize the grade of green building and relevant technical indicators at the construction site of the construction project.
