Chapter I General Provisions Article 1 In order to strengthen the supervision and management of construction activities, maintain the order of the construction market, ensure the quality and safety of construction projects, and promote the healthy development of the construction industry, these Regulations are formulated in accordance with the provisions of the Construction Law of People's Republic of China (PRC), the Bidding Law of People's Republic of China (PRC), the Safety Production Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this province. Article 2. Engaged in construction activities within the administrative region of this province and implementing supervision and management of construction activities shall abide by these regulations.

The term "construction activities" as mentioned in these Regulations refers to the construction of various houses and their ancillary facilities and the installation of supporting lines, pipelines and equipment. Third provincial people's government construction administrative departments to supervise and manage the province's construction activities.

The administrative department of construction of the people's government of a city or county (city) divided into districts shall supervise and manage construction activities according to the hierarchical management authority stipulated by the administrative department of construction of the provincial people's government.

The construction administrative departments of the people's governments of provinces, cities divided into districts and counties (cities) may entrust their subordinate institutions with the function of managing public affairs to implement specific supervision and management of construction activities. Chapter II Construction Permit Article 4 Before a construction project starts, the construction unit shall apply for a construction permit to the construction administrative department of the people's government at or above the county level where the project is located. Except for the construction projects that have approved the commencement report according to the authority and procedures prescribed by the State Council and the small-scale construction projects below the limit prescribed by the provincial construction administrative department.

To apply for a construction permit, the construction unit shall provide a certificate of capital availability issued by the bank. If the construction period is less than one year, the funds in place shall not be less than fifty percent of the contract price of the project; If the construction period exceeds one year, the funds in place shall not be less than 30% of the contract price of the project.

The construction administrative department shall, within fifteen days from the date of receiving the application, issue a construction permit to the qualified application.

If the construction project fails to obtain the construction permit or the commencement report is not approved, the construction unit shall not carry out the construction. Article 5 After obtaining the construction permit, if the original construction permit items change due to special circumstances, the construction unit shall apply to the relevant departments for the change procedures according to law; In line with the statutory conditions, the construction administrative department shall re-issue the construction permit within fifteen days. Article 6 Survey, design and construction units engaged in construction activities, as well as bidding agencies, supervision agencies and engineering quality inspection intermediary service agencies of construction projects, must apply to the construction administrative department for corresponding qualification certificates in accordance with the relevant provisions of laws and administrative regulations, and engage in construction and intermediary service activities within the business scope specified in the qualification certificates. Seventh professional and technical personnel engaged in construction and intermediary service activities, special types of personnel, should obtain the corresponding qualification certificate or post qualification certificate, and engage in construction and intermediary service activities within the business scope specified in the qualification certificate. Chapter III Contracting and Contracting of Construction Projects Article 8 A construction project shall be contracted by tender according to law. If it is not suitable for contracting by tender, it may be contracted directly. Ninth all the use of state-owned capital investment, as well as state-owned capital investment in the holding or leading position of housing construction projects and municipal engineering projects, should be in the construction engineering trading center in accordance with the law of public bidding. If the lender and the fund provider have different provisions on the specific conditions and procedures of bidding for projects with loans or aid funds from international organizations or foreign governments, their provisions may apply. However, unless it is against the interests of People's Republic of China (PRC).

The establishment of a construction engineering trading center shall be approved by the construction administrative department of the State Council or the provincial construction administrative department. The construction administrative department shall strengthen the supervision of the construction engineering trading center.

The construction engineering trading center shall be separated from the relevant government departments and their subordinate institutions. Tenth construction engineering trading center shall provide the following services:

(1) Providing places and facilities for bidding activities;

(two) to collect, store and publish information such as bidding, policies and regulations, materials and equipment prices, and provide consulting services for all parties to the construction project transaction;

(three) to provide conditions for the relevant government departments and their management agencies to implement supervision and management;

(four) other services related to the transaction activities of construction projects. Eleventh construction engineering trading center and its personnel shall comply with the following provisions:

(a) shall not have affiliation or economic interests with any bidding agency;

(two) clear fees, public fees, fees shall not be charged in violation of regulations;

(three) shall not disclose the internal information of the bidding activities in any way;

(four) shall not participate in bid evaluation and selection activities, and shall not recommend bidders to the construction unit;

(five) found illegal activities in the bidding activities, shall report to the construction administrative department or other relevant departments;

(six) shall not illegally interfere with the bidding activities in any other way. Twelfth of the construction, survey, design, construction units and intermediary service institutions engaged in construction activities and their professional and technical personnel, the construction administrative department shall establish a credit file, and announced to the public.
