Regulations of Xining Municipality on the Administration of City Square

Article 1 In order to strengthen the management of city squares, maintain the normal order of squares, protect environmental sanitation and municipal public facilities, and provide a good environment for activities and rest for the public, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the square management of leisure, entertainment, assembly and other activities open to the public in this Municipality.

The squares included in the scope of management of these regulations shall be determined and promulgated by the people's governments of cities and counties. Article 3 The organizations established by the municipal, district and county people's governments with the function of managing public affairs shall carry out the daily management of the square; Urban construction, gardening, urban management, public security and other administrative departments shall perform administrative functions according to their respective responsibilities. Fourth units and individuals entering the square should consciously abide by social morality, civilized sightseeing and rest, maintain the order and environmental sanitation of the square, and accept the management of the square management personnel. Fifth square management organizations should conscientiously perform their duties, strengthen management, maintain the order of the square, ensure the square buildings, structures and municipal public facilities in good condition, carefully maintain the flowers and trees in the square, and keep the square clean and beautiful. Article 6 Units and individuals entering the square shall take good care of municipal public facilities and shall not commit any of the following acts:

(a) damage to the square floor pavement, sprinkler facilities, seats, square pigeon houses, bulletin boards, galleries, sculptures, public telephones, lighting, signs, manhole covers, isolation guardrails and other municipal public facilities;

(two) unauthorized construction of buildings and structures, excavation (road) surface. Seventh units and individuals entering the square should take good care of green space, flowers and trees, and shall not have the following acts:

(a) the occupation of green space, piling up debris in the green space, digging a hole to borrow soil;

(2) Destroying and carving trees and picking flowers and fruits;

(3) trampling on green land and flower beds. Eighth units and individuals entering the square should take good care of environmental sanitation, keep the square clean and beautiful, and shall not have any of the following acts:

(a) spitting, urinating or littering peels and scraps of paper;

(two) the goods loaded by the vehicle are scattered, flying and leaking;

(3) scribbling, depicting and drawing on buildings and structures;

(four) hanging, drying, burning items;

(five) catching and hurting pigeons in the square;

(six) the pet is harmful to others or affects the environmental sanitation;

(seven) washing in water spraying facilities;

(eight) to set up a stall at will;

(nine) dinner, drinking and engaging in gambling, superstition and other uncivilized activities. Ninth motor vehicles and non-motor vehicles entering the square shall abide by the traffic regulations of the square and prohibit the following acts:

(a) in an area where traffic is prohibited;

(2) Failing to park the vehicle at the designated place;

(3) Wash the vehicle. Tenth in the square to engage in the following activities, should be approved by the relevant administrative departments, with the consent of the square management agencies:

(1) Organizing entertainment, sports, exhibitions, consultation and publicity activities;

(two) advertising or hanging, posting promotional materials;

(3) Maintenance, repair and installation of municipal public facilities.

If the square facilities are damaged due to organizing various activities, they shall be repaired or compensated. Eleventh in violation of the provisions of this Ordinance, the relevant administrative departments shall be ordered to make corrections, resulting in damage to the square facilities, and shall compensate for the losses, and according to the seriousness of the case, shall be punished according to the following provisions:

(a) one of the acts listed in article sixth, can be given a warning or a fine of 50-500 yuan;

(two) one of the acts listed in article seventh, can be given a warning or a fine 10- 100 yuan;

(three) one of the acts listed in article eighth, can be given a warning or a fine of 5-50 yuan;

(four) one of the acts listed in Article 9 may be given a warning or a fine of not more than 50 yuan. Twelfth units or individuals entering the square, in violation of public security management, by the public security organs in accordance with the provisions of the "Regulations of the people's Republic of China on administrative penalties for public security"; If the circumstances are serious enough to constitute a crime, it shall be dealt with by judicial organs according to law. Thirteenth law enforcement officers of the relevant administrative departments shall produce their law enforcement certificates and issue a written decision on administrative punishment when implementing administrative punishment; The collection of fines shall issue a receipt for fines uniformly printed by the provincial finance department. Confiscated income shall be turned over to the finance at the same level. Article 14 if the staff of the relevant administrative departments and square management institutions fail to perform their duties, neglect their duties, abuse their powers or engage in malpractices for selfish ends, they shall be given administrative sanctions by their units or the competent department at a higher level; If the circumstances are serious enough to constitute a crime, it shall be dealt with by judicial organs according to law. Fifteenth if a party refuses to accept the administrative punishment made by the relevant administrative department, it may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the Administrative Reconsideration Law of People's Republic of China (PRC) and the Administrative Procedure Law of the People's Republic of China. Sixteenth specific issues in the application of these Regulations shall be interpreted by the Xining Municipal People's Government. Article 17 These Regulations shall come into force on August 1 2002.
