In order to thoroughly implement the Opinions of the General Office of the State Council on Further Strengthening the Work of Coal Mine Safety Production (Guo Ban Fa [2013] No.99), and strive to realize the safe and sustainable development of the coal industry in our province, combined with the actual situation in our province, with the consent of the provincial government, we hereby put forward the following implementation opinions.
First, speed up the closure and withdrawal of backward small coal mines.
(1) explicitly closes the object.
Increase the closure of small coal mines with a capacity of 90,000 tons/year and below, focus on closing coal mines with a capacity of 90,000 tons/year and below that do not meet the requirements of safe production, and speed up the closure of coal and gas outburst mines with a capacity of 90,000 tons/year and below.

(2) Major and above production safety accidents occur, or production safety accidents with cumulative deaths of 3 or more people occur within 1 year;
(3) The super-layer cross-border refuses to return, and the resources are exhausted;
(4) illegally organizing production during mine construction;
(five) refusing to carry out the order to suspend production for rectification, but still organizing production and construction;
(six) the use of backward technology prohibited or eliminated by the state and the province, after the suspension of production for rectification, the normal mining has not been realized within the time limit;
(seven) after the suspension of production for rectification, it has not reached the three-level standard of safety and quality standardization within the time limit.
2. There are major production safety hazards such as coal and gas outburst, spontaneous combustion, rockburst and flood threat in coal mines. The local people's governments at or above the county level organize experts to demonstrate that it is difficult to effectively prevent and control it under the existing technical conditions, and the local people's governments shall close it down. (2) Increase investment guarantee. Provincial departments should actively strive for state investment, focusing on supporting the upgrading and transformation of safety technology in coal mining enterprises. It is necessary to give full play to the guiding role of financial funds, highlight investment priorities, improve investment methods, and vigorously support the key work of coal mine safety production. (3) Strictly examine and approve coal mine construction projects and allocate resources.

2. Strict conditions for examination and approval of construction projects. No longer approve coal mines with new production capacity below 300,000 tons/year; It will stop approving the reconstruction and expansion (including resource integration) of mines with a production capacity of 6.5438+0.5 million tons/year; All coal and gas outburst mines with a production capacity of less than 900,000 tons/year will stop new construction; Coal mine construction projects below the level of geological exploration or without mechanized mining conditions (including new construction, reconstruction and expansion of mines) shall not be approved. For existing production mines with serious disasters such as coal and gas outburst and rock burst, in principle, the expansion of production capacity will no longer be approved, and the production capacity will be re-approved before the end of 20 15, and the production capacity will be reduced for mines without safety guarantee capacity. 3. Strict resource allocation. Coal resources with serious disasters such as coal and gas outburst coal seams, spontaneous combustion coal seams, rock burst and extremely complicated hydrogeological conditions are no longer allocated to small coal mines with a production scale of less than 300,000 tons/year; No new resources will be allocated to mines with 90,000 tons/year and below that do not have the conditions for mechanized upgrading and transformation; Under the detailed investigation of geological exploration degree, resources which are difficult to be mined and mechanized, such as coal seam thickness less than 0.4m, coal seam dip angle greater than 60 degrees, and coal seam mining height less than 1.0m, are no longer allocated to coal mines except as protective layers for outburst coal seams. Eliminate the forward mining method, and it is forbidden to use informal mining methods such as multi-branch roadway, coal pillar roadway and warehouse mining in the coal mining face. (five) strict access to coal mining enterprises and management personnel.
1. Strict access to coal mining enterprises. Coal mining enterprises that do not have the corresponding disaster prevention and control capabilities shall not pass the safety examination and approval or merge and reorganize other coal mines with high gas, coal and gas outburst, rock burst, spontaneous combustion of coal seams and complicated hydrogeological conditions; Coal mine construction enterprises without corresponding disaster grade construction qualification and performance shall not build coal mine construction projects with disasters such as coal and gas outburst, rockburst and spontaneous combustion of coal seams and complex hydrogeological conditions. 2. Strictly manage personnel access. Enterprises engaged in coal production must have a management team with relevant majors and practical experience. Coal mines must be equipped with trained and qualified mine managers, chief engineers and deputy mine managers in charge of safety, production and electromechanical, as well as professional and technical personnel engaged in coal mining, tunneling, electromechanical transportation, ventilation and geological survey. Professional and technical personnel must have a coal mine technical secondary school education or registered safety engineer qualification, and have more than 3 years of underground work experience. Otherwise, it shall be ordered to suspend production for rectification and temporarily suspend the safety production license. 3. Encourage professional safety custody of coal mines. Encourage professional safety management teams and superior coal enterprises to manage small coal mines by means of trusteeship and shareholding, and improve the technology, equipment and management level of small coal mines. Custody parties must sign an agreement or contract to clarify the relevant safety production management responsibilities. After coal mine safety custody, both the entrusting party (coal mine custody) and the supporting unit shall bear the responsibility for production safety. 4. Establish a credit management system for coal mine safety production, and improve the safety production commitment and safety production classification management system. Carry out safety integrity assessment and safety integrity demonstration enterprise creation activities. Four, deepen the comprehensive management of coal mine gas and water disasters.
(6) Strengthen the basic management of gas.

(1) The chief engineer or technical director of the mine with high gas, coal and gas outburst is the first administrative deputy; Independent ventilation mechanism must be set up in high gas mines, and outburst prevention mechanism must be set up in coal and gas outburst mines (which can be combined with ventilation mechanism); Gas-rich mines are not less than per ton of coal 15 yuan, gas-rich mines are not less than 30 yuan, and coal and gas outburst mines are not less than the standard extraction safety production cost of 50 yuan, in which the gas control cost is not less than 50% of the extraction cost. Those who fail to meet the above requirements shall be ordered to make rectification within a time limit, and those who fail to make rectification within the time limit shall be given a heavier punishment.
(2) Coal and gas outburst mines must strictly implement regional and local "two-in-one" comprehensive gas outburst prevention measures; All mines must ensure the normal operation of the gas monitoring system, and each coal mining and tunneling working face must be equipped with full-time gas inspectors to follow the work; Gas overrun must immediately stop production and evacuate people, find out the reasons and implement preventive measures. Otherwise, it shall be ordered to suspend production for rectification and deal with it according to law.
2. Strengthen gas drainage and utilization. In mines with high gas, coal and gas outburst, a fixed gas drainage system shall be established in accordance with the regulations to ensure that all gas is pumped out and the drainage reaches the standard; People's governments at all levels and relevant departments shall implement the policies of the state to promote the extraction and utilization of coalbed methane (coal mine gas), such as financial subsidies, preferential taxes and fees, and online power generation. The people's governments at the county level and provincial key coal mining enterprises organize the investigation and management of regional water disasters, formulate the implementation plan for the investigation and management of regional water disasters in coal mines, and delineate the warning lines and forbidden mining lines for coal mining and tunneling faces, goaf water accumulation in each coal mine. Coal mining enterprises should establish water prevention and control institutions, fully staffed with water prevention and control personnel, and strictly implement the requirements of the Regulations on Water Prevention and Control in Coal Mines. Five, a comprehensive investigation of coal mine hazards.

Coal mining enterprises must find out the gas, water, fire and other hidden dangers and related mining conditions within the mining scope. If it is not found out, comprehensive exploration technologies such as geophysical prospecting and drilling must be used for supplementary exploration, otherwise construction and production may not continue. When the conditions of mine geology and hydrogeology change greatly, the corresponding geological report should be revised in time. Six, vigorously promote the "four modernizations" construction of coal mines.

Local people's governments should study and formulate policies and measures to encourage mines that have reached the second-class safety and quality standardization. (ten) to speed up the mechanization, automation and information construction of coal mines.
1. Formulate the conditions and standards for coal mine mechanization upgrading in our province, and encourage and support the mechanization of small coal mines below 300,000 tons/year. Mechanized transformation and upgrading to the minimum production capacity stipulated by industrial policy must be approved by the relevant provincial departments, and it is not limited by the years of upgrading production capacity, grade and service life of resources. The implementation of mechanized transformation and upgrading of mines, in line with resource allocation policies and conditions, can increase resource allocation. The existing coal mines that have not realized mechanization of mining and transportation must realize mechanization in a planned and step-by-step manner before the end of 2020. 2. Simplify the examination and approval procedures for mechanized transformation. Strengthen the promotion of advanced technology and equipment, strengthen the docking between scientific research institutes and equipment production enterprises and coal mining enterprises, and encourage them to cooperate in various ways. Coal-producing counties (cities, districts) should encourage and guide institutions of higher learning, scientific research institutions, intermediary institutions or large coal mining enterprises to set up technical service institutions or establish a team of coal mine experts locally to provide technical services for the government's coal mine safety supervision and coal mine safety production, especially for the "four modernizations" construction of coal mines. In principle, coal-producing counties (cities, districts) with an annual output of more than 6.5438 million tons should establish coal mine technical service institutions in their own regions, speed up the construction of outburst prevention laboratories in southern Sichuan and eastern Sichuan, and provide technical support for coal mine gas disaster control. Seven, strengthen the responsibility and labor management of coal mine managers.

The chairman, general manager, coal mine owners and mine managers of coal mining enterprises must strictly implement the Seven Provisions of Mine Managers on Protecting Miners' Life Safety, and it is strictly forbidden to subcontract at different levels and "manage by contract"; Mining in strict accordance with the approved areas, and organizing production without exceeding strength, super ability and approved scope; Mine drawings are consistent with the actual situation underground, and the real situation of safety production shall not be concealed, and supervision shall not be evaded, and the instructions of superior safety supervision shall be strictly implemented. Any coal mine that violates the above provisions shall be suspended for rectification. (thirteen) standardize coal mine labor. Coal mining enterprises shall sign labor contracts with employees in accordance with the law, pay labor remuneration in full and on time, and the salary of employees shall not be lower than the local minimum wage standard. Coal mining enterprises should do a good job in employment registration according to regulations and pay social insurance premiums for employees according to law. It is strictly forbidden to use the contractor team or contract, subcontract or lease underground projects and mining faces, and to put an end to "hosting by contract". (14) Protect the rights and interests of coal miners. Coal mines must strictly implement the national legal holiday system and working hour system, provide labor protection, working conditions and occupational hazard protection for workers, and improve dust-proof facilities; Carry out occupational health training, organize regular occupational health examination, and establish occupational health monitoring files. Production mines should evaluate the current situation of occupational hazards at least once every three years, and incorporate occupational health into the "three simultaneities" work of construction projects. All coal mine employees must be certified after passing the examination. The people's government of the city (state) shall exercise safety supervision over all coal mines (including state-owned key coal mines) within their respective administrative areas, and the people's government at the county level shall be responsible for exercising safety supervision over other coal mines within their respective administrative areas except municipal and above. According to the coal mine management authority to implement rectification (including active shutdown) of coal mine supervision responsible person and resumption of production acceptance department. All coal-producing counties (cities, districts) should be fully staffed with coal mine safety supervisors and managed in strict accordance with regulations, and strengthen the supervision and investigation of illegal coal mine production and construction or organization of super-capacity, super-strength, super-quota and super-approved operations. Coal mine safety supervision departments in coal-producing counties (cities, districts) with an annual output of 1 10,000 tons or more shall be equipped with chief engineers and safety supervisors specialized in coal mines. Nine, improve the scientific level of coal mine emergency rescue.

Relying on provincial key coal mining enterprises, six provincial regional mine emergency rescue bases will be established in southern Sichuan, eastern Sichuan, western Sichuan, northern Sichuan, Panxi and Chengdu to provide services for regional coal mine emergency rescue; Each coal-producing city (state) and county (city, district) should build a professional emergency rescue team for coal mines, and its operation and maintenance costs should be supported by local finance. 2. Coal mining enterprises shall establish emergency rescue teams in accordance with relevant regulations. Coal mining enterprises that do not have the conditions to set up a full-time mine rescue team alone must sign an ambulance service agreement with the nearest full-time mine rescue team and establish a part-time ambulance team. Rescuers must be trained and qualified and hold relevant certificates. Coal mining enterprises must formulate emergency plans, establish unified production, ventilation and safety monitoring and dispatching, and organize emergency drills for all staff at least once a year. 3. Strengthen the construction of coal mine emergency rescue equipment. Coal mines should improve emergency hedging, compressed air self-help and water supply and rescue systems according to regulations, be equipped with underground emergency broadcasting systems, and reserve self-help and mutual rescue equipment. Promote the use of advanced equipment that can quickly open the "life channel", coal mine emergency command, communication, emergency power supply and other equipment and mobile platforms, as well as rescue equipment such as life detection and search and rescue positioning for people in distress, large-scale demolition of disaster sites, and special protective supplies and equipment for rescuers. 4. Strengthen coal mine accident emergency rescue command and overall coordination. Establish and improve the rapid response coordination mechanism of coal mine emergency rescue. After the coal mine accident, party committees, people's governments at all levels and responsible persons of relevant departments should immediately rush to the scene of the accident in accordance with the relevant requirements of the Interim Provisions of Sichuan Province on "Party and Government Responsibility" for safety production. In the event of major and following accidents, an accident rescue headquarters with the main person in charge of the people's government at the county level as the commander shall be established; In case of major and above accidents, an accident rescue headquarters with the main person in charge of the municipal (state) people's government as the commander should be established to direct the rescue. Rescuers who died in coal mine emergency rescue and disaster relief meet the conditions for evaluating martyrs, and declare martyrs in accordance with relevant state regulations. This opinion shall come into force as of the date of issuance and shall be valid for 5 years. If the relevant provisions previously issued are inconsistent with these implementation opinions, these implementation opinions shall prevail. The implementation opinions shall be interpreted by the Provincial Safety Supervision Bureau and the Sichuan Coal Supervision Bureau.
